Donald Trump says Ted Cruz’s Canadian birth “could be a difficult problem” for 2016 bid
The Dallas Morning News ^ | January 23, 2015 | Todd J. Gillman

WEST DES MOINES, Iowa – Billionaire Donald Trump, the most prominent “birther” to question Barack Obama’s eligibility to serve as president, asserted Friday that Sen. Ted Cruz must clear up legal doubts about his own eligibility due to his birth outside the United States.

“It’s a problem. It could be a difficult problem, but he admits that he was born in Canada,” Trump told reporters in Iowa on the eve of the first major gathering of 2016 presidential hopefuls.

“He’s a friend of mine. I have great respect for him. But …certainly it’s a stumbling block and he’s going to have to have it solved before he goes too far,” Trump said.

Cruz was born in Calgary, Alberta, on Dec. 22, 1970, while his parents worked in the Canadian oil patch. His mother is a native-born American. His father, a Cuban émigré who later became a naturalized American, was still a Cuban citizen at the time.

Cruz’s birth in Canada was never a secret. But it has proven a political liability, with detractors occasionally taunting him as “Canadian Ted,” and critics suggesting that his birth outside the United States makes him ineligible to run for president.

In August 2013, The Dallas Morning News reported that the circumstances of his birth made him both a Canadian and an American. The dual citizenship came as a surprise to Cruz and his parents, and the senator quickly vowed to shed his Canadian citizenship. That became official last June.

For Trump, that’s not yet good enough if Cruz wants to run for and become president....

There have also been trials held on the merits. For example: see Farrar v. Obama, Swensson v. Obama, Welden v. Obama, Powell v. Obama in Georgia or Purpura and Moran v. Obama in New Jersey. There are video excerpts of both of these trials available on You Tube.

You are correct that quite a few lawsuits were dismissed for lack of standing. That’s due to the fact that the people who have standing decided not to file suit or to join any existing lawsuits as co-plaintiffs. The people with standing who could demonstrate DIRECT injury-in-fact are the candidates who also received electoral votes and who had an opportunity to be elected president/vice president: John McCain, Sarah Palin, Mitt Romney and Paul Ryan.

Since you are so good at keeping track of trials, how many have there been on the issue of homosexual marriage? How many judges have discovered that the purpose of the US Constitution is to establish and protect homosexual marriage?

Now do count them all up. Don’t leave any out. The exact number is so important. At least it is to you, as I have seen you post exact numbers for eligibility cases multiple times. [Hint: the only people who know exactly how many times the courts have backed Obama are Obots. But you knew that already.]

FW, as you know, my boredom with this line of country has begun to reach the pathological.

So, taking all I have gleaned from contemporary sources, I booked a room at The Holiday Inn Express, put pixel to screen, and my research has now uniquely qualified me to end the Natural Born Citizen controversy thing. It is not entirely original, but a compendium of rulings from the courts, low , high, and silent, the mutterings and utterings of elected Republican representatives at the local, state, and federal levels, and the rulings of bureaucrats who handle the citizenship and immigration thing without adult supervision. There is no need for any of the above parties to have a copy of the Constitution or refer to it in any way.

Obamperial Decree

Be it hereby known
that if any of one's ancestors within 15 generations of one's birth,
shook hands with someone who was
contemplating becoming an American Citizen,
that person, regardless of race, creed, color, or country of origin,
is hereby declared a
"Natural Born Citizen"
of the United States of America
and a full-blooded Cherokee Indian,
given a Hawaiian Birth Certificate,
a CA Drivers License,
an EBT Card,
in-state tuition at any state university,
a free Che Guevara tee shirt,
and is good to go as a candidate for POTUS.

Well, OK! But wouldn't it just simplify things if the back-room boys just came right out and said it? BTW, what, or who is a citizen nowadays?

‘BTW, what, or who is a citizen nowadays?’

Just listen to what Obama says and watch what he does. Figure out who he’s insulting, putting down or harming by his words and actions. As soon as you have them identified, you know who the US citizens are.

I.e.: they are the ones Obama is trying to, and doing a very good job of, ruin/ruining.

Ok, then why was that birth certificate not shown to a trusted agent of the press? Obama released a non- document. A pasted and layered electronic melange was all that was. Proven to be a forgery or a mixture of a few different documents His 18-year-old military document (what is that thing called, I should know, I have a son turning 18 next month) was completely different in the dating than any of the others done that year.

Believe me, there are hinky things about his citizenship. Yeah,, there are super crazy birthers. But there is no conclusive evidence he was American.

If someone could convince any judge in America, from a small claims court judge to the Justices of the Supreme Court, that Obama’s birth certificate is a fake, I would be delighted. That has never happened.
If someone could convince a member of Congress that Obama’s birth certificate is a forgery, I would be overjoyed. That has never happened.
If someone could convince any of the fifty Chief Election Officers in the states of the Union, usually a Secretary of State, that Obama’s birth certificate is a “non-document,” I would be ecstatic. That has never happened.
Once the Republican Governor of Hawaii verified the authenticity of the original document, interest in pursuing judicial or state or federal legislative action against the document waned.

The only birth certificate for Obama that would ever matter is not the scanned images that are seen on the Internet but the original, hard copy version that has been in the Hawaii state Registrar’s office safe since 2011.
Here’s how Fox News covered the original hard copy:
http://www.foxnews.com/politics/2011/04/27/obama-birth-certificate-moved-secure-location-months-ago/

Under Hawaii law, the orginal hard copy can be inspected if a judge issues a court order for its release. no judge has ever issued such an order.
Another way to see the original would be if a person “having a common ancestor” with Obama requestd a copy of the original.
It turns out that the Tea Party-endorsed candidate for the U.S. Senate in Kansas who ran against Senator Pat Roberts, a radiologist named Dr. Milton Wolf is a cousin of Barack Obama. Dr. Wolf and Obama are related through Thomas Creekmore McCurry (1850–1939), President Obama’s great-great-grandfather, and Dr. Wolf’s great-grandfather. Obama’s grandmother, Madelyn Dunham, was Milton Wolf’s mother’s first cousin. Obama’s mother and Dr. Wolf’s mother were friends in Wichita, Kansas, where the president’s mother, Ann Dunham, was born and spent part of her childhood.
Dr. Wolf could be entitled to a copy of Barack Obama’s birth certificate.

“not just a rule, but it is in the Constitution”

I totally agree - meant to put “rule” in quotations to indicate the downgrading of this very important component of Presidential eligibility.

“Ok, then why was that birth certificate not shown to a trusted agent of the press? “

Samantha Guthrie of NBC News asked for and received that opportunity. She also took smart phone photos of it.
Lester Kinsolving of worldnetdaily.com also received a copy of that birth certificate in his press packet.

A copy of an original document? Or a printout of the computer generated image?

No, it’s not a problem. Because Cruz’s mother was a CITIZEN of the USA at the time he was born, he is considered a citizen of America. And .. because he was born in Canada, he was also a citizen of Canada. A lot of people have dual citizenship .. it’s nothing new or weird.

Cruz has given up his Canadian citizenship .. so now, he’s just an American Citizen.

Trump is blowing smoke. I think Trump is serious about running, and Cruz would probably be his stiffest competition. If Trump is play dirty politics, he will be out of the running very soon. Cruz has always said he was a dual citizen. He’s never hid that fact. And .. Cruz made it public when he gave up his Canadian citizenship.

If Trump is unaware of that fact; it’s his problem. But, he better stop trying to smear Cruz because it will come back to bite him.

NBC’s Samantha Guthrie says that she held it and felt the raised Seal plus she took photos of one of the two hard copies of the original document that the Hawaii’ Health Department released to Obama’s Attorney Judith Corley.

J. Scott Applewhite, a photographer for the Associated Press also says that he took photographs of a hard copy of the original document.

But if there are doubts, under Hawaii Revised Statutes, a judge can court order the release of the original document for inspection and I’m reasonably certain that a congressional subpoena could also accomplish release for inspection as well.
I’m surprised that the Hawai’i Registrar of Vital Statistics has never been deposed or subpoenaed to testify under oath before a congressional committee of the House. The original document is supposedly in his office safe.

FOR IMMEDIATE RELEASE: April 27, 2011
HAWAI‘I HEALTH DEPARTMENT GRANTS PRESIDENT OBAMA’S REQUEST FOR CERTIFIED COPIES OF ‘LONG FORM’ BIRTH CERTIFICATE
HONOLULU – The Hawai’i State Health Department recently complied with a request by President Barack Obama for certified copies of his original Certificate of Live Birth, which is sometimes referred to in the media as a “long form” birth certificate.
“We hope that issuing certified copies of the original Certificate of Live Birth to President Obama will end the numerous inquiries related to his birth in Hawai’i,” Hawai’i Health Director Loretta Fuddy said. “I have seen the original records filed at the Department of Health and attest to the authenticity of the certified copies the department provided to the President that further prove the fact that he was born in Hawai’i.”
On April 22, 2011, President Obama sent a letter to Director Fuddy, requesting two certified copies of his original Certificate of Live Birth. Also on that day, Judith Corley, the President’s personal attorney, made the same request in writing on behalf of the President. (Letters from President Obama and Ms. Corley are attached).
On April 25, 2011, pursuant to President Obama’s request, Director Fuddy personally witnessed the copying of the original Certificate of Live Birth and attested to the authenticity of the two copies. Dr. Alvin Onaka, the State Registrar, certified the copies.
President Obama authorized Ms. Corley to pick up the documents. On April 25, 2011, Ms. Corley appeared in person at the Hawai’i State Department of Health building in Honolulu, paid the requisite fee, and was given the two certified copies, a response letter from Director Fuddy to President Obama, and a receipt for payment.

"Rubio does qualify. He was born Miami to legal resident parents and was a citizen at birth. Nothing could stop Cruz from running either, he was born a citizen just like Rubio, just like Jindal, all 3 of them, period. That is all natural born means, there is no extra special definition, no there’s not, I don’t care what you heard on some blog or from some radio host."

How about what Congressman Bingham said on the issue? Does that matter?

"Cruz is a natural born U.S. citizen. He was an American citizen at birth. He never received and never required naturalization."

The Minor court would disagree. So too would the father of the 14th Amendment on citizenship.

Neither would apply here. State/local courts don't contol Federal elections. The 14th Amendment deals with who has citizenship and the power to vote, not qualifications to run for office.

Section 1 deals with the qualification to run for president and all it says is "natural born citizen". I say he is one. Maybe you says he's not. Fine. Let him run. Let SCOTUS do their job (for once). They can rule and then we'll all know.

Just from the comments on this thread, I'd say Trump has a point.
