And I’m not seeing how the 1st Amendment guarantees enrollment in the university.

It may not, but it may protect you once you've been accepted.

We'll see.

We just now know that the students quit OU before being expelled. A school cannot expel you if you quit.

Not necessarily. If an employer gives you a choice of "resign or be fired", you can still sue the employer for wrongful termination. Similarly, if it can be shown that the students were given a choice of quitting or being formally expelled, then they can still go after the university for violation of their Constitutional rights.

No, all it means is that knowing that after being expelled from OU, they would never be accepted to another school, as they would have to explain why they were expelled from OU.

You note that everyone will know about the incident forever. On the other side of your mouth, you argue that they would have to explain why they were expelled. I suspect they were not allowed enough time to confer with legal counsel as to the ramifications of resign vs be expelled.

Being that they were not under criminal indictment or charges, they were not afforded Sixth Amendment protections.

OK so if he doesn't represent the two expelled students then what can he sue the university over? Disbanding the fraternity? The university didn't do that, SAE did. Evicting the students? The university evicted students from the frat house but they do own it, and once the fraternity chapter ceased to exist then there was no reason why they couldn't. Labeling the fraternity members as racists? I think the members themselves did that. So what's left?

Yes, I believe he represents the SAE members who did not withdraw from OU, but does not represent the national SAE organization.

He has no case.

The students who were on the video singing that racist song can only hope people forget and have nothing to gain except for humiliation and embarrassment by suing OU.

But those students haven't been expelled and haven't withdrawn. So what do they have to sue the university over?
