Sgt. Bowe Bergdahl, the U.S. soldier who was recovered in Afghanistan last spring after five years in captivity, faces charges of desertion and misbehavior before the enemy, according to his lawyer.

UCMJ Article 104:

“(1) aids, or attempts to aid, the enemy with arms, ammunition, supplies, money, or other things; or
(2) without proper authority, knowingly harbors or protects or gives intelligence to, or communicates or corresponds with or holds any intercourse with the enemy, either directly or indirectly;”

My guess is that the Army does not have enough evidence to proved him guilty of Art 104. One can assume or think that he may have done that, but an Article 32 hearing and subsequent courtsmartial would require hard evidence.

Besides, as we can see, there is a right way and a wrong way to wear facial hair.

OK I looked and it wasn’t very specific. More hard numbers were in the (granted it’s NYT) piece from 2007.

I am no UCMJ expert, but it seems to me the article 99 is more serious than the article 85. The reason, and the article allude to this, is that Bergdahl deserted in a combat zone and went to the enemy. My quick research suggests thousands did desert in Iraq and Afghanistan, but many left before deployment and after already serving tours. Many only received one year jail time.

I believe you're correct. Of those thousands of desertions only a handful occurred while deployed. And many are downgraded to AWOL thus the short sentences. 99 refers to Misbehavior specifically before the enemy, far more serious charge and less common charge.

Wow. They can drag this out for a while yet.

Like I said, he needs to plea. In the military he gets the lesser of the agreement or the judge’s sentence on hearing the guilty plea. The judge is not permitted to know the plea deal.

So, if a judge heard his confession and gave him 10, and the plea was for 7, then he gets the 7. The military prosecutor or the judge could both highball it, though. If they thought they could curry favor with the CIC, then they would lowball it. Obama’s only got less than 2 years left. The Army went out on a limb charging him with both desertion and misbehavior. Down the road, favor curried today wouldn’t look so good under a more conservative administration.

Man oh man does seeing something like that drive me freakin’ up the wall. All the vets who died, were maimed for life and this piece of rat filth posing as our POTUS surrendered everything they fought for back to the enemy, and not only that, he is also HELPING THEM FIGHT THE UNITED STATES and our allies! This is just utterly unbelievable, they forced Nixon to resign over a freakin’ 18 minute tape, and this PUNK just commits one blatant act of treason after another after another after another after another. I got it down on my tagline, I’ve been counting them... 15 acts so far! This country has to rebel, it really does.

The charge is "Misbehavior before the enemy" which is cowardice.

The US military has voted about 2/3rd conservative and 1/3 liberal over the last four decades at least since I’ve been paying attention. By nature, the military does not like leadership that doesn’t understand the military’s mission is winning wars. Anything that makes that less likely threatens the nation and threatens lives. Obama has made that less likely.
