Amtrak facing costly personal-injury claims from crash victims

Amtrak likely faces hundreds of millions of dollars in claims from victims of the derailment of a northeast regional train at Frankford Junction in Philadelphia Tuesday night, according to personal-injury lawyers who specialize in transportation accidents.

Because Congress capped such payouts for Amtrak in 1997, money to compensate victims probably will fall short of what is needed, these lawyers say.

Under the Amtrak Reform and Accountability Act, damages paid by the government to people injured in Amtrak derailments and families of those passengers killed was limited to $200 million per crash. But with eight killed and about 200 of the 238 passengers injured, some very seriously, claims from this week's crash almost surely will exceed that amount.

Isn't AMTRAK govt. subsidized ... which means ... we taxpayers pay for it ?

And if so, wouldn't settlements come out of our pockets ala "bailout" ?

There are 8 dead and only a few critically injured. Like I said before, most of the money should go to them. You are right about the critically injured needing more for medical care. I’m just saying the people who walked away with scrapes or bruises don’t need big windfalls.

Lawyers will unfortunately walk away with most of it.

Spend years and years in chronic pain due to the negligence of this driver and see if 50k or even 100K is enough. It’s all well and good to talk about caps until it happens to you.

You live your life and then BAM - someone’e negligence turns your life upside down and changes everything you knew or had hoped for in the future.

Amtrak engineers are government employees. Will the gay engineer be fired, or just reassigned to different duties?

$200 million isn’t even close to enough.

And there will be lawyer's fees as well. A severely injured person who is awarded, say, $750,000 is not going to actually get $750,000. It's a real mess.

Absolutely. Few in the government are held accountable anymore. What were firing offenses 50 years ago (chronic tardiness, coming to work drunk, etc.) are now just slaps on the wrist. That actually encourages irresponsible behavior.

If Congress capped awards to $200 million per accident, then legally how can they give out more. By law, that would be illegal.
