A federal appeals court on Friday struck down an Idaho law banning abortions after 20 weeks of pregnancy, ruling the law unconstitutional.
The ruling comes a few weeks after the U.S. House passed legislation that would ban abortions after the same timespan, sending it to the Senate.
The 9th Circuit Court of Appeals said Idaho's law violates Supreme Court precedent protecting abortions up to the point of viability for a fetus, which has been considered to be around 24 weeks.
Courts have struck down such bans before. In 2013, the 9th Circuit also ruled an Arizona ban on abortions after 20 weeks of pregnancy to be unconstitutional. The Supreme Court declined to hear a challenge to that decision.
Ten states currently have 20-week abortion bans, according to the pro-abortion rights Guttmacher Institute.
When the 20-week ban was moving through the House this month, supporters argued the effort was intended to set up a court challenge down the line.
I think this is likely to get a challenge in the court, and I think its likely to prevail, Rep. Chris Smith (R-N.J.), co-chairman of the Pro-Life Caucus, told The Hill this month.
There has been rising support for 20-week bans among Republicans. The anti-abortion Susan B. Anthony List has touted that a wide-range of likely Republican presidential candidates support such bans, with New Jersey Gov. Chris Christie announcing his support in March.

how does anybody sleep at night and knowing they ordered the murder of babies that are over 20 weeks along. I don’t get it.the American public is in favor of this ban and the Republican candidate should not be afraid to use it in the race.and I know that does no good for the babies that are 20 weeks and under but if we can save lives then we must do our best. This is a first step. A complete ban isn’t going to happen all at once.
Scientists have to anesthetize in-utero baby mice that are halfway through gestation before removal from the mothers womb (for experiments) because scientists think they are able to feel pain. Just sayin’.

Clearly these jurists have nothing to do with Constitutional law and everything to do with being leftist political hacks with an agenda.
There is no Constitutional basis for this ruling.
I have come to the opinion that the federal court system is nothing but a bunch of leftist kangaroo courts in the employ of DC despotism.
It’s past time for state nullification of federal over reach.

Barack Obama has had 311 federal judges confirmed by the U.S. Senate.
113 of them were confirmed unanimously, 38 were confirmed by unanimous consent, 63 were confirmed on a voice vote. That’s 214 judges who were unchallenged and 97 who were challenged.
6 Obama nominees were rejected via Republican filibusters of their nominations. Obama withdrew all six nominations and nominated a different judge who was then confirmed in all six instances.
The latest Obama federal judges to be confirmed are Jill Parrish to the District Court for Utah and Jose Rolando Olvera, Jr. for the Southern District of Texas. They were both confirmed 100-0 on May 21, 2015.
Federal judges stay on the bench until they decide to step down, then they can work part time as Senior Judges or unless are removed via impeachment, trial and conviction.
In the history of the Republic, 8 federal judges have been convicted in impeachment trials and removed from offce. Three federal judges who were impeached, resigned and 4 impeached judges were acquitted at trial.
