States Don’t Have to Comply: The Anti-Commandeering Doctrine

Most Americans believe that the federal government stands absolutely supreme.

Nobody can question its dictates.

Nobody can refuse its edicts.

Nobody can resist its commands.

This is simply not true.

Laws passed in pursuance of the Constitution do stand as the supreme law of the land. But that doesn’t in any way imply the federal government lords over everything and everybody in America.

LOL. I was reading this article and I envisioned a solder in intense battle in say Vietnam and some reporter saying “you know we really are in a war” as bullets are whizzing by.

The tanks I used to ride around in and take to the firing range when I was in the Army National Guard. We also conducted civil disturbance training in the wake of Kent State, no tanks involved.

We were always told that we could be `Federalized’, but only with the consent of the Governor of our state.

Now, not up on the details, but didn’t Eisenhower federalize the Arkansas National Guard in 1957 to enforce desegregation, without the consent of Orville Faubus, governor?

The State can then stop tax withholding for the federal government. It is not their responsibility, and they can direct it back onto the workers. Let them pay it on April 15th in a lump sum.

If they can't compel officers of States to enforce immigration law, then they can't compel officers of States to issue homo marriage licenses. No?

This is kinda what Ted Cruz is saying- He’s suggesting states do NOT have to comply because those states were NOT listed in the lawsuit brought before the supreme court, and only the state that brought the lawsuit must comply-

He knows the law better but he told Katie Couric that states are NOT legally obligated to abide by the law- Katie was flabberghasted, no doubt thinking she had something major on Ted now- but Ted knows law inside and out, and no doubt knows the federal government can NOT enforce the two unconstitutional laws nationally for the reasons he cited

This is exactly wht happened years ago- the federal government tried soemthign similar, making a law, having supreme court rule on it, SC I guess upheld it- then gov tried enforcing it, but states overruled and refused to comply, and the law was defeated- can’t remember now which law- but states banded together and would not allow the law to be enforced I ntheir state-

What the federal government can do, however, is withhold federal funds (taken from the states) unless the states knuckle under to its edicts.


And that is the kicker... The money is “taken from the States”. Do not let it be “taken from the States”. Have the Governor of each emboldened State to force the Comptroller to suspend the taxes leaving the State going to the Fed pig trough.

Now who would have to knuckle under to the edicts?

Not different from States/Cities that have legalized pot, which is Federally illegal but the Feds just look the other way.
