If they're breeching a contract you surly can....that's what deposits are for, troll.

No, deposits are to protect the venue against loss resulting from the renter's breach. The non-breaching party is entitled to be made whole, but is not entitled to a windfall.

The venue may or may not have a duty to try to mitigate its damages (depends on what state you're in), but if the venue DOES mitigate its damages, they are not entitled to the windfall of keeping both deposits.

Go back to law school, troll.
