There is no crime involved since there is no legal requirement for a candidate or a president to use a birth certificate to prove eligibility.

More significantly, that the information has been verified as matching the original means there's no legal issue. There's no misrepresentation of fact.

We can debate the hierarchy of significance! Federal administeative law says that a U.S. Passport is primary evidence of citizenship and identity and a birth certificate is secondary evidence.
