Rohnert park police ["Are you some kind of Constitutionalists?' Rohnert Park Cop pulls gun on guy]
youtube.com ^ | Aug 3, 2015 | RRryan 71187

Posted on 08/04/2015 12:22:26 PM PDT by KneelBeforeZod

Citizen seems to notice a police officer driving around and around his neighborhood while he is working on his boat in his driveway.

Police officer doesn't like being filmed by someone in his own yard and decides to stop and pull gun on him.

“Do we not have a right to be armed on our own property anymore? “

Actually, under current California (read effed up) law, you may only be armed on your property if it’s fenced and has gates to prevent unfettered access.

“I have family who are cops and know first hand their deranged mentality. It is total brainwashing. They see every car, person, dog, cat, mouse, hamster, goat, pig, and fly as a potential lethal threat. They are trigger happy paranoids that find reward for shooting things.”

My wife has a friend who is married to one of our town’s former Chiefs. It’s somewhat sad, but true nonetheless, that they become very different people than the rest of society over time I suspect due to their $hit environment. He’s been retired for any number of years, but still hasn’t manage to deprogram himself entirely. Also, they carry a lot of guilt from their actions, this guy joined a church.

“Do police, without a warrant, and no probable cause, have the authority to give you orders on your own property?”

NO, but they can usually get what the want by intimidating you. Waiving a gun tends to achieve “compliance.”

Just one hold-out on this one.

Yep, this badge licker will need a really good chiropractor to untwist the contortions. Amazing how some will just not let go but go down with the ship.

A lawful command ...

predicated on....?

As previously stated, cops can't just walk around ordering everyone the see to show their hands.

But the question posed was “without probable cause!” All the $hit you mention are in the realm of probable cause are they not?

I didn’t know that filming in your own neighborhood and hooking up your boat were on the list of “probable cause” items.

We have to get past this bit about their safety “trumping” our rights. Most of the cops today are “hammers” and all if us are “nails.” All of us have the right to go home tonight unharmed.

You just can’t seem to separate a cop’s normal prerogative from the very real limitations on said prerogative.

“When you are pulled over for a ticket, let’s say, he can ask you to keep your hands visible. He’s acting in accordance with the law, detaining someone who’s violating the law.”

When you are pulled over for a traffic violation, you are, under the law, under arrest! You get to go on your way by signing the citation in which you promise to appear to answer whatever the charges are. This cop had no cause of any kind to detain this man for filming him. It was pure intimidation from a cop who thought he could get away with it. Looks as though he should have thought twice about pulling the gun. He’s going to go, would be my bet. All you have to do is look at the Rohnert Park PD Facebook page.
The $hit has really hit the fan!

“If what your friend says is correct, cops, as another poster put it, can simply walk down the street barking out orders and everyone must comply.”

And “your friend” is going to cost some municipalities a bunch of money with his “advice.”

The cop made several trips around the cul de sac if you listen to the guy. I would have to be wondering myself what is up with this guy, cop or otherwise. Then he pointed his finger like a gun at the guy while he was still in the car and took his picture. He not only pulled his gun but advanced on the guy, so much for the BS he was in fear for his life. He made no attempt at cover in the least. He was grey haired, he wasn’t a rookie. It in fact looked like he was going to execute the guy. This POS needs to be in prison where he belongs after seeing a shrink, or thrown off the force for being stupid with a gun if he passed that. There was no call to pull his gun period, this very much was an attack posture.

Only brutes use force, Wise men use virtue. IP man

"Yes it is the officer’s business. Bullets cross property lines quite easily."

That kind of law and policy is indeed being increasingly implemented by the most influential constituents and their state and local government interests. Thanks for showing it to the general public.

Feel free to have your own opinion.

For my part, I would not wish to have this officer near me for any reason whatever.

I am thinking this might be an ongoing issue that wasn’t mentioned on Mr. McComas’s FB post...maybe a “boat parked in driveway for weeks” type thing. Rohnert Park has muni code specifying that boats/RVs/other vehicles move every 72 hours or be parked in a side yard behind a fence or in a garage. https://goo.gl/W7sbDG

All you have to do is look at the Rohnert Park PD Facebook page.

Thanks for mentioning it. Their comment:

Regarding video of Rohnert Park Public Safety Officer:

We’ve been made aware of this matter and we are taking it seriously. We understand the concerns that have been raised by our community and others and we want the public to know that your trust in law enforcement in our City is a top priority. As a result, we will conduct an internal review to verify that appropriate protocols were followed. We will also review our protocols because we want to make sure we are using the best practices for the highest level of safety for both our officers and the community.

“Show your hands. It is the law and any even marginally rational person will do so immediately as it could save your life.”

Sorry pal, in this setting, NO SALE! This cop acted illegally under color of law, and he should be punished as such. This was a blatant attempt at mindless intimidation. The cop was just pissed that a mere resident citizen ( i.e. someone who is paying his salary) “dared” to photograph him on patrol. There were no laws being broken before this asshole got out of his car, and if he had used his gun, he’d be in the same fix as the criminal cop in Cincinnati last week. Cameras are going to change law enforcement for the better. A decent officer would not have behaved as this guy did and FWIW, I love good LEOs. Our daughter-in-law’s best friend was the girlfriend of the Hayward, CA cop that was killed last week. He was a very good officer and we are all saddened by his passing.
The line between a LEO’s “right” to go home safely each day and the same “right” for the rest of us needs to be redefined. Cops on the whole, have become far too trigger happy, and before the advent of the small camera, they have always been able to get away with an unjustified killing, because they had their “friends” in the DA’s office.(Baltimore is a notable exception)

Did you read the “incoming” comments? Their comment is what you would expect from a couple of politicians, but the citizen comments are much more inflamed!

Drago said: ... maybe a “boat parked in driveway for weeks” type thing.

Allow me to post the quote from Atlas Shrugged.
"Did you really think we want those laws observed?" said Dr. Ferris. "We want them to be broken. You'd better get it straight that it's not a bunch of boy scouts you're up against... We're after power and we mean it. . . There's no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren't enough criminals one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws."

Possible backstory...

Reading through some of the facebook comments, I saw this.... of course, I have no idea if it's true or not, so take it with a grain of salt.

=snip=

Robin Boyce Gerard Giudice I respect your opinion... Again this man is not a cop hater. He is going through some legal issues with his family. He himself did Not commit any crimes, yet is being harassed for over a year because he decided to stand up for what he in his heart believes is right. Without going into detail, this video was recorded solely to get the attention of RPPSD and to validate his claims of harassment... He did not expect this to go viral and did not want the "Media Attention" this is why he declined to be interviewed by ABC News... He just wants to be left alone.

How would you feel, of officers constantly drove by your house, harassing you? This officer was there Solely to taunt and harass this man!

If he was there for any other purpose then he would have said that reason.

I appreciate your stance for LE mine is too usually wanting to back them and I don't want our streets to be patrolled by weak officers. They're not suppose to be nice when dealing with criminals.

Don is not a criminal, he's a good person, father, husband, employee and a law abiding citizen. It's crazy what's been happening for the last year or so, and I'm happy he finally got something on video to validate his claims! Oh that's why the officer was there because Don filed a claim against a officers with RPPSD and PPD the day prior to this event. Coincidence?
=end snip=

We have to get past this bit about their safety “trumping” our rights.

No, we have to get THEM past this bit about their safety "trumping" our rights.

If they can't act in accordance with that dictate, they need to find another line of work.

Can you imagine firefighters all telling each other "the most important thing is that I get home safely tonight."?
