The complication is this — THE CHILD IS TODAY (emphasis) CONSIDERED AN AMERICAN CITIZEN BY OUR LAWS ( whether we like it or not ).
You can lawfully deport the illegal parent(s), but you can;t deport the child.
Therefore, if you deport the parent(s), you are tearing up the family.
I’ve see FReepers give many different answers:
1) Send the child to an orphanage
2) Send him to foster care
3) Give him up for adoption.
All are legitimate answers, but regardless, it does not make you look good.
What law? Name it.

Her hostile demeanor and gotcha questions do nothing but waste everybody's time. Demanding a yes/no answer for a hypothetical situation is far from an intelligent assessment of the problems and potential solutions on how to deal with the continuing flood of illegal immigrants and abject and total failure of our government to enforce the law.
The leftists want to jump on the practicality of how are we going to deport 20 million illegals. Instead she should realize and acknowledge that common sense says to stop the leak first. Get rid of illegal alien gang members and convicted criminals in our jails. Stop them from coming back when they have been deported.
Then take the time needed to deal with the illegal aliens in an orderly fashion after the leakage has been stopped.
Instead, like other leftists in the media Kelly and her ilk want to make up gotcha questions so they can congratulate one another on how clever they are. Those days are over now that we have "adult supervision" in the room.
Let me break it down for you.
Cruz is saying that her question is the wrong question. It is putting the cart before the horse.
First and foremost we must shut the invasion down. Secondly we have to sort through all of these people and make some decisions. Outright criminals and deadbeats have to go back immediately. People that have been here illegally for up to three generations, own homes businesses, have children and grandchildren and are pillars of the community. Maybe we want to keep them. Others in between we have to look at on a case by case basis. It is going to be very difficult to make those choices.
However, at this point it is a distraction to start trying to make judgments before we have dealt with the priority of getting control of our borders.

Illegal aliens are NOT under the jurisdiction of the United States. Period. And jurisdiction doesn’t mean laws. I suggest listening to Mark Levin on this along with reading Andrew McCarthy, Hans Von Spon....(can’t spell it), etc.
1) Tip comes in on the illegal alien tip line.
2) ICE agents swarm in pick them up and deposit them in a holding tank.
3) Judge reviews their case and decides they're illegal aliens.
4) They are deposited by bus, train or plane in their country of origin.
5) Tipper gets paid $500 bounty.
6) Repeat 30 million times.
1. We are not deporting the children. We are deporting their parents. There would be, under current case law, no legal basis to “deport” the children.
2. HOWEVER, we can’t force those “citizen children” to stay in the US either. This is America: we don’t restrict the international travel of our citizens. The parents have the absolute right to take their children with them when they are deported.
3. The children are not guilty of a crime. Only pro-abortion liberals punish children for the very act of being born. Only liberals think it would be a good idea to split up families.
4. What a racists question. Why does Megyn think that illegal immigrants are heartless, soul-less parents willing to leave their children behind?
The answer is really simple. NO. There is no legal mechanism for "deporting" U.S. citizens.
The parents, however, should be deported. Why are people making this so complicated?
Under current law, as it has been interpreted and enforced under the Code of Federal Regulations, yes, they are “subject to the jurisdiction” of the United States. Period.
Again, there is an open question as to whether Congress could clarify the meaning of “subject to the jurisdiction thereof,” and exclude the children of illegals, but Congress has not done so, meaning that, as things stand now, the children of illegals ARE citizens.
I’m not arguing what the law should be (I tend to agree that they should not be citizens, as that is a significant motivator for people to cross the border/fly over here). I’m just saying how things are working, right now.
