I make the mistake of thinking you are reading and understanding this thread as closely as am I.

Did you miss the part about the governor calling a special session? Even though I reminded you with the "burning up the wires" comment?

Let me repeat myself for the fourth or fifth time. If the legislature is convened in emergency session, they can pass a law immediately stripping all clerks of duties to issue marriage licenses.

Again, Alabama and Oklahoma have already done something like this. (Or so I am told.)

The 14th Amendment does not entitle the Federal government to usurp powers not enumerated in the Constitution.

Being that all KY marriage law states that marriage is heterosexual, and thus all KY marriage law is ruled invalid by SCOTUS, what law gives her authority to license ANY marriages?

I am not a lawyer but I am smelling a trap here. I am sure the gaystapo has this well rehearsed. Probably even planned before the ruling by the Eminent Tribunal. I have a feeling that somehow they are looking to establish a precedent.

I'm saying that society has long since given legal sanction to the process that has resulted in this consequence, and confirmed it many times by continuing to vote and re-vote in the cretins who keep it in place.

This is the end result of having two big government parties. It's the bed we made, and now we're laying in it. If Republicans had been serious about small government instead of just using it as a throwaway talking point, we would never have gotten to this point.

I’m glad that you mentioned this. Note that the 14th Amendment applied the Constitution’s Clause 3 of Article VI, particularly the prohibition of religious tests, to the states.

No one requires her to perform the marriage. All she is being asked to do is certify the people applying meet the requirements set by the law.

She is not being asked, “Do you approve of this marriage?” She is being asked, “Have these applicants complied with the law?”

If she was being required to participate in the marriage, or to perform it, or to approve of it as moral in the eyes of God, I’d support her. But all she is being asked to do is see if X & X have complied with the law.
