State governments can avoid a lot of trouble by simply eliminating marriage licensure entirely. Just come out and say that anyone who claims to be married (even if it is five men and twelve women) is free to consider themselves spouses, and be done with it.

It might happen. It is to the ill in some ways, but the ideas of “marriage” have become thoroughly crazy today. Better to do nothing than to do harm.

Even Scalia has gone soft; he said in his dissent in Obergefell that he did not care what the law was, only that it was politically unseemly what had happened.

If were President I’d order her release by executive decree just like Obama does all the time, failure to obey would result in the Army being sent to liberate the jail.

Someone should lock up this Judge.

1. Taxes? Eliminate joint tax filing entirely. This is the least credible argument for a legal recognition of marriage because it suggests that government taxation should have anything to do with marriage.

2. Children? I'm not sure what you mean by this. Families would still exist, and would probably be happier and healthier when they stop giving a sh!t about what their government thinks of them.

3. Property? Inheritance? These would be subject to normal contract law. You can jointly own property with anyone, and if you want someone to inherit your assets then simply write them into your will.

Looks like that's Jonathan Adler's interpretation of Scalia’s opinion of this case. I think there's a difference in that state law differs from the Supreme Court decisions and again, these types of societal changes are best left to the people not the courts or we have tyranny.

Why because the Legislature and the Governorr failed to act ? It is kind of odd that a federal judge sou;odin effect issue a writ of mandamus to a county clerk. She is not even a federal officer. It is up to the state to take action here.

The only argument that I have heard for same-sex marriage that has merit is the hospital argument. I do not buy the argument but it does have some merit. The hospital argument goes something like this; When a person it critically ill only family members are allowed to visit, sans a marriage license one “partner” would be denied the ability to see and give comfort to a loved one on their death bed. I think their is a work around but at least the hospital argument has some merit.

I posted a remark some time ago to the effect that hospital visitation rights in the early AIDS era were the motivation for the gay marriage movement. Someone responded that the premise was false because visits were allowed, but of course that is the way I remember it, notwithstanding.
