Kim Davis Might Get Sued for ‘Unauthorized Public Performance’ of ‘Eye of the Tiger’

Kim Davis walked out to Survivor’s “Eye of the Tiger” when she was released from jail Tuesday.

A judge ruled that Davis should be released from jail as long as she doesn’t interfere with the licenses that her deputies have been granting.

However, she infringed upon Survivor’s rights when she played the 1982 rock classic as she walked on stage to give a speech.

Record label EMI has considered suing Davis, as well as her supporter Mike Huckabee, for publicly playing the song without permission.

“They are well within their rights to hold a public rally in support of Kim Davis, or anyone else for that matter,” intellectual property attorney Paul W. Steiner. “Where they broke the law was when they played that song by Survivor without the permission of the rights holder.”

Steiner says that often times, record labels and musicians will turn the other cheek when their songs are publicly played without authorization.

“Though, in this case, I believe that EMI does not want their song associated with someone like Kim Davis, or Mike Huckabee for that matter, and will most likely seek full damages for this incident.”

“The song has motivated thousands through the years to reach beyond their limits. Its use for the release of Kim Davis does not support my views or my politics. I have contacted my publishers to make sure this usage is stopped immediately,” Survivor’s founder Jim Peterik told Billboard.com.

Frankie Sullivan, who co-wrote the song with Peterik for Rocky III, took to his Facebook page to express his dismay at Davis’s use of their song.

“We did not grant Kim Davis any rights to use ‘My Tune -The Eye Of The Tiger.’ I would not grant her the rights to use Charmin!”

Just to clarify Rush does not support PETA ,and it is Hynde’s money to do what she wants.
That’s too much like guilt by association, essentially what most of the bikers in Waco were jailed for, and a Constitutional violation.
I see no evidence of there ever being a PETA lawsuit against the EPA.

Huckabee and his people were pretty stupid to use that dumb song anyway. Kim Davis should sue Huckabee for trying to make the whole thing about him and his campaign.

One of the most horrid songs of all time anyhow.

Conservative events should ban the use of music from filthy hippies and leftists such as that raunchy and atonal "song". Far better would be to use pro-American Patriotic marches and/or pro-God Southern Gospel music.

She wrote the song, she can do what she wants with the money. She actually agreed to let him use it.

If I had a song, I would accept royalties, but I wouldn't police who used it. Well, maybe if Nazis were using it.

It’s funny, all this stems from the guy from Survivor having a problem with the use of his song.
Talk about needing exposure.
What did Survivor ever do besides the Rocky themes?
I thought the music was “plastic, and Manufactured” anyway. Totally created for Hollywood.
Can anyone say Vangellis “Chariots of Fire”? Yuk, what crap.

Apparently, they had 6 other Top 40 hits, including 4 other top ten hits. One of theirs was #2 from the next Rocky movie. I don't understand why they wouldn't want royalties.

Oh, I’m sure they’ve made millions from that song. I used to like the song when I was in school but got tired of it after several years.

The point is that the band didn’t need to be such arrogant jackasses over the use of the song. They need to take their butthurt out on Huckabee, not Kim Davis.

Why are you so sensitive about someone not liking the song? Are you friends with the band members or something?

who needs canned music at any political ( or otherwise ) event anyway? I thought the music was lame and out of place . Folks have to stop trying to jack around other folks emotions with cheap tricks and ‘songs’

I was mistaken. It doesn't appear there was a formal lawsuit, just a publicity campaign. In Hynde's own words,

That’s weird, because I’ve also read several times that she allowed him to use it because her parents listened, and just on general principal.

In this instance I would agree with PETA’s position as well.

Testing medication on animals, I got no problem with.
Testing hairspray, by spraying it in some animal’s eyes serves no purpose except cruelty.

I have a solution for both.
Let’s test chemicals on Government Bureaucrats.
They’re much more useless than most animals. :)
