These Justices need to be periodically reviewed for suitability. The story states that one of the cases involves the death penalty, which it claims Breyer looks prepared to rule to be unconstitutional - even as the 5th Amendment implicitly permits it.

“The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.”

Prohibition had to be enacted through Amendment, because it was once believed that Congress, thanks to the above, did not have the power to legislate such matters for the States.

Now, however, we have a Court (or a majority of five justices) who usurp the power of both Congress and the States, to legalize abortion, probably outlaw the death penalty. legalize gay marriage, etc. etc.

All hail the new oligarchs.

(But where do they get the authorization to do any of this?)

Exactly. The Supreme Court has lost all credibility. We will need to change the constitution to fix it, otherwise the states need to just immediately nullify whatever they say.
