So what happens if affected owners refuse to get the refit that will hurt the performance of their vehicles???

Our car has to pass an emission test every year to update the registration. So if a VW can pass the test without the refit wouldn't that be OK?

More to a conservative county. That test is only required in liberal El Paso, Travis and Williamson counties and the DFW and Houston/Galveston areas.

The firmware identifies "test mode" and sets parameters to pass the tail pipe emissions test. When test mode is not in operation, the engine parameters are switched to values that optimize power and fuel economy. The "fixed" firmware would leave the params that meet the air quality test to the detriment of performance and economy.

EPA plans to add a "road test" to the lab test in the future to catch "cheating".
