Just Watched Trump on Special Report with Bret Baier (vanity)

Posted on 10/06/2015 3:22:51 PM PDT by RoosterRedux

He was incredibly good. Gave specifics, was strong, was presidential.

And what energy!

I will post a video when it hits youtube.

The "public use" only applies to the Federal government.

With all due respect, that is incorrect. The "public use" requirement applies to all uses of eminent domain, federal, state or local. Even in Kelo (a municipal use of eminent domain), the issue was whether the transfer of property to a private developer could be a public use. The Supreme Court (wrongly) held that such a transfer could qualify as a "public use," and therefore could be permissible; had it not been a "public use," it would have been prohibited. So, no, states are not exempt from the "public use" requirement at all.

Thomas Jefferson on property rights:

“The true foundation of republican government is the equal right of every citizen in his person and property and in their management.”

“He who is permitted by law to have no property of his own can with difficulty conceive that property is founded in anything but force.”

Yet we see conservatives on this thread dismissing those rights, even mocking them, because for them, no Constitutional right is as important as Trump.

I don’t like TPA or TPP or the Corker bill. I can’t imagine why anyone here would think any of those are just fine either.

None of these candidates are perfect.

As far as eminent domain goes. I understand the need at times, but I think the person being displaced should get a really good price for their property. It should also not be overused.

Keeping it all in perspective, I hate the Kelo decision, but stopping illegal immigration and anchor babies is infinitely more important to the longevity of our rerpublic. Thank God for Trump getting it front and center in this election cycle.

To hell with the GOPe and all amnesty pushing RINOs!!

I vacillate between amusement and disgust watching how some folks here swoon for him and attack anyone who questions him.

He is the ONLY choice. If he gets out of the race, America is gone and anyone who's watched both Republicans and Democrats the last 8 years knows it.We don't swoon, we support. None of the others could survive the hits and all of the others are already deeply in debt to the puppet masters. Trump is our single hope for survival.

Individuals or developers do not impose imminent domain, cities, states do. They do it in order to build roads, schools, hospitals, libraries...anything and everything that is a gov’t function. Cities also have agencies that are geared toward economic development. Those agencies use imminent domain to acquire property for those purposes. These agencies DO pay a fair price for property, however they do not pay a huge over value price because if they did we would never have a road or a hospital etc. When they acquire property for these purposes it is YOUR money they are using to buy these properties. You cannot hold a developer up as a tyrant for using property a city has made available to them to do with what they wanted to be done. Also you might want to ask how much the KOCH brothers use imminent domain for all their pipelines....it IS extensive. Don’t be lead around by the media, their only desire is to deceive you.

A fine example of "a bad deal".

I'm betting the grandson was her big influence.

After she won, she moved in with the grandson, and the helpful grandson put it on the market for $5 mil. That didn't work. Couldn't even sell it for $1 mil.

It was eventually sold for half a mil and there was probably a big tax bill to pay.

There were some pictures of the inside. It was a sty. It was fine in it's time.

Carson could be ok, but he seems like a weak sister to me.

There’s a couple things I don’t like about Cruz, but I’m pulling for him anyway. Praying he makes it.

In the meantime, I really like the job Trump is doing in this election cycle. There are some things about him I don’t like, but his strong points far outweigh his negatives, IMHO. If he keeps going at his current pace and doesn’t screw up, he will win the nomination and if he does, I’ll proudly support and vote for him in the general.

Screw the GOPe and all of its amnesty pushing RINOs.

‘This Rooster poster is just showing his character, mean and ugly. It’s easier to attack and smear than to exercise the brain by thinking.’

But saying these spiteful things behind another person’s back—gossiping about him in public—is nice?

With all due respect, that is incorrect. The "public use" requirement applies to all uses of eminent domain, federal, state or local.

The 5th amendment originally only applied to the Federal Government, and neither imposed any legislation on eminent domain nor restricted the State's right to do whatever it pleased on the matter. The 14th amendment, in its turn, was never designed to take away any of the State's rights. So the question is, can the Federal Government stop the State from having broader or less broad eminent domain laws, provided that due compensation and due process is always kept? The answer is no.

Secondly, yeah for "overcoming his financial struggles". What's in your wallet?

My wallet's just fine thank you. I got what I need.

Thirdly, why would you elect a President for his faith?

It's kinda important to me

A few years back, when I lived in Massachusetts, the town I lived i took a parcel of my land to build a pumping station - as they were converting the neighborhood over to a city sewer system. I got a Town hearing but the result was pre-ordained. They were taking my land. The only thing I got out of the hearing was they increased the amount they offered me from $45,000 to about $60,000.

So I took the money and they took the land and built the pumping station. So it goes. I guess I could have chained myself to a tree and become a cause celebre but I'm a busy guy and needed to get on with life.

The ultimate use of eminent domain however was when the Europeans settled North American and displaced the native Indians. So if one is opposed to eminent domain, in order to be consistent, they would have to yield up their property to the nearest Indian tribe - or at least start paying them rent.

The neighborhood my mother grew up in during the 1940s was seized, leveled and graded, and now its part of Interstate 93 just before it enters Boston. The property owners were paid above market value and they were able to rebuild elsewhere. And life went on.

Now I understand Trump was trying to build a limousine parking lot or something like that. He offered the owners a decent amount of money (million dollars for some run down shack?) and they refused. So he availed himself of the court system to try and get his way. Maybe he did, maybe he didn't. Either way, Trump didn't "seize" anybody's property. Either the courts decided it was a proper case of "public use" or they didn't.

It's important to know his faith. He unabashedly identifies himself as a Christian. Is it important to you to know what prayers he says, how much church he misses, or maybe how many Bible verses he's memorized?

You're electing a President not taking a wife.

Why is he running? Why are people backing him? Because people like to work and create. Just like their Creator, as a matter of fact.
