Is this text of Obama executive action on guns?

The highly influential Center for American Progress, widely considered the “idea factory” for the Obama administration, has drawn up a blueprint for presidential executive action on gun control that goes beyond media descriptions of the proposal being weighed by the White House.

Since the mass shooting in Roseburg, Oregon, earlier this month, it’s been widely reported that President Obama is considering circumventing Congress with executive action to tighten federal law on gun sales.

NBC News quoted administration officials saying Obama’s major gun-control proposal would set specific guidelines for who is legally defined as a licensed gun dealer, since all licensed dealers are required to conduct background checks before conducting any sales.

The proposal, NBC News reported, would set quotas on yearly gun sales for individuals to qualify as legally being “in the business” of selling guns once they sell a certain number and thus become subject to all laws for gun dealers.

The news agency quoted sources revealing the White House is considering setting the quota at 50 or 100 gun sales per year as the threshold to trigger the requirements, although the sources added the administration has not formally settled on a specific number.

The reports of an executive action focus on a federal law that requires anyone “engage[d] in the business” of “dealing in firearms” to obtain a federal firearms license from ATF and become a licensed gun dealer.

Every licensed gun dealer is then mandated to conduct background checks prior to completing each gun sale.

Currently, the federal statute defines those “in the business” of gun sales as follows:

If you understood anything about this you realize the real targets are the guys that rent a table at the gun show.

They want to ban all private sales and this is the incrementalism that will eventually get them there.

No, those are only required for licensed dealers, right now.

I can sell you a gun, or you can sell me a gun, and neither of us has any obligation to report it to the feds.

The Supreme Court doesn't agree with you and the Constitution says they have a say in the matter.

If you understood anything about this you realize the real targets are the guys that rent a table at the gun show.

They want to ban all private sales and this is the incrementalism that will eventually get them there.

I've been to many a gun show and see the same sellers over and over, trying to sell their overpriced junk in many cases. If it's a side business for them, they should be licensed sellers, just like the real gun stores. It's an unfair business advantage for them compete on an unlevel playing field. A once per year exemption would still allow the occasional seller to set up and sell.

That's exactly my point. Since I know they'd never do such a thing, I wouldn't agree with implementing the EO in the first place. As Secret_Agent_Man mentioned, it's all about incrementalism and to that I say "Not one inch!".

Scotus also ruled slavery was okay. Scotus has ruled its okay to take peoples private property and give it to other citizens if it is claimed it will help the local economy. They also created a right to abortion and gay marriage out of nothing.

This is a case where scotus gets it wrong. Shall not be infringed means just that. Only lawyers and politicians and tyrants look at that and say it says or means domething otherwise.

No. The forms are maintained by the dealer for twenty years. Then they can be destroyed. If a FFL goes out of business then the ATF gets the forms that the dealer is holding.

It is against Federal law for the ATF to use those 4473 Forms to create any type of data base (registry) that includes the buyers names.

As for me, I will assert that "shall not be infringed" includes "infringed by the Supreme Court."

This could make a lot of banks and trust companies gun dealers. Many wills provide for institutional trustees or executors. The estate that’s transferred to such an entity often contains a substantial number of firearms. What if the number of firearms in all of those estates in the possession of an institutional trustee exceeds the magic minimum? Does that then make the XYZ Bank a firearms dealer that needs a FFL??
