Bernie Sanders' union supporter calls for him to consider independent run

One of Bernie Sanders’ biggest union supporters has called on him to consider running as an independent candidate if Democratic party leaders continue to refuse to give him access to his campaign’s voter records.

The Democratic National Committee suspended all access for the Sanders team to a shared database system as punishment for a data breach in which a number of staff accessed records belonging to Hillary Clinton’s campaign during a software glitch.

Someone pointed out in my thread earlier today, in the absence of a majority the House of Representatives would pick the top candidates and the U.S. Senate would vote on who would be the next President. Lincoln was elected this way with 40% of the popular vote.

The House was not involved in either of Lincoln's elections; both times he received a majority of the electoral votes.

If nobody receives a majority of the electoral votes for President, the House picks from the top 3 electoral vote receivers. If nobody receives a majority of the electoral votes for VP, the Senate picks from the top 2 electoral vote receivers. Read the 12th Amendment for more details.

There is something I do not understand about the Sanders run. He is not a registered democrat. How can he run in a democrat election?

It would seem more practical (and legal) for him to run as an independent. :-)

I don’t understand that either.

There was a lawyer with Sanders when he registered as a candidate in New Hampshire as he could have been challenged on the spot.

He’s more of a faux challenger to make Hillary look more moderate and young. They laughed and then Bernie started filling large venues and beating her in the N.H. polls.

They know if she loses early it could remove the illusion of her invincibility and she’d have a real primary challenge on hand.

Again, will Bernie break out the chainsaw during the debate Saturday?

If so, Hillary has got a lot of weaknesses to go after.

Wouldn’t a runoff with the two highest vote getters be better. Then the President would have a majority of electoral votes.

Not sure why they went for the House route.

12th Amendment

The Electors shall meet in their respective states, and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves; they shall name in their ballots the person voted for as President, and in distinct ballots the person voted for as Vice-President, and they shall make distinct lists of all persons voted for as President, and all persons voted for as Vice-President and of the number of votes for each, which lists they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate.

The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted.

The person having the greatest Number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the states, and a majority of all the states shall be necessary to a choice. And if the House of Representatives shall not choose a President whenever the right of choice shall devolve upon them, before the fourth day of March next following, then the Vice-President shall act as President, as in the case of the death or other constitutional disability of the President.[Note 1]

The person having the greatest number of votes as Vice-President, shall be the Vice-President, if such number be a majority of the whole number of Electors appointed, and if no person have a majority, then from the two highest numbers on the list, the Senate shall choose the Vice-President; a quorum for the purpose shall consist of two-thirds of the whole number of Senators, and a majority of the whole number shall be necessary to a choice. But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.[1]

This part of the 12th Amendment is superseded by Section 3 of the 20th Amendment, which provides that if there's no President elected by Inauguration Day then someone (VP or statutory successor) becomes Acting President until a President is elected.
