Ted Cruz and Donald Trump threw down over the birther question. Cruz was ready for Trump and blew him up by pointing out that by his own standard, Donald Trump wouldn’t be eligible to run for president because his mother was born in Scotland.

Cruz got a question about Trump’s birther claims. Sen. Cruz pointed out that Trump said his lawyers examined Cruz’s citizenship, and it is a non-issue. Cruz delivered the line of the night, “Since September, the Constitution hasn’t changed, but the poll numbers have.” Cruz said that the birther theories that Trump has been relying on require two parents to be born on US soil, which means that Trump would be disqualified because his mother was born in Scotland.
Trump responded by saying that he is leading in the last three polls in Iowa, and the Cruz is going down. Trump cited Lawrence Tribe and other constitutional attornies who say Cruz can’t run. Trump said that he already knows that the Democrats will be filing a lawsuit about Cruz’s citizenship. Trump said, “There is a big overhang. A big question mark on your head. You can’t do that to the party.” Trump said that you had to have certainty.
Cruz responded that he has defended the Constitution in the Supreme Court and that this lawsuit has zero chance of succeeding. Cruz said that Trump is parroting attack lines from Hillary Clinton.
Sen. Cruz has proven to be the only other Republican candidate to toe to toe with Trump.
The Republican establishment should be very afraid because the only person that stand up to Trump on the GOP side is Ted Cruz.

Don’t you think it is time to protect and defend the Constitution? This is a Constitutional question. Trump is right. It has to be settled and Cruz, being a Constitutional “expert” is trying to dodge the issue because he knows Trump is right. He expected to get away with it because of Obama and maybe the thin line of “precedent.” however, two wrongs do not make a right.

It doesn't. Nor does it have to. The 14th amendment cannot be construed to change the meaning of words in constitutional law that are not specifically addressed by the amendment. That is even Supreme Court interpretational Doctrine.
Amendments cannot be interpreted to change Constitutional law by accident. Changes must be intentional, and specifically addressed.
Does the equal protection clause not tell us that to disregard the mother in favor of the father is NOT EQUAL PROTECTION?
Since Women didn't get the right to vote till 1919, and since the holding of Minor v Happersett (1875) is that there is no constitutional requirement that women must be treated the equal of men, then there is no evidence in the absence of a constitutional amendment specifically addressing the issue, that we have to treat citizenship passed down by women the same as that of men.
It wasn't, according to the Founders understanding.
I'm not attacking Ted Cruz, Fred. I like Cruz. I'm voting for him if Trump doesn't make it.
But he's no more immune from Media DeathStar attacks than was Sarah Palin.

Cruz “hometown” in the United States since the age of 4 is the most liberal, homosexual-loving city in the SW United States. If he was so “conservative”, the minute he got out on his own he would have moved away from that progression hell-hole.

Actually, what really matters most is public opinion. The legal issue was a non-starter with Obama only because the media poo-pooed it and didn't give it any street cred. In this case the media are giving traction to the story and that is why one-fourth of Repubs are questioning Cruz status.
Cruz can eventually win the legal opinion on this but the fact that it is a story hurts him more every day it is alive. This is what Trump understands from his experience as a showman and promoter and why I think he gave good advice to Ted to get this out of the way sooner rather than later (even if he did give the advice for political reasons).
People will argue legal opinion on who was born where and when all day but simply the question being out there is costing Cruz eventual votes every day and the damage may well be done and a legal ruling in Cruz's favor doesn't necessarily translate into winning votes.
I see this improvement happening now with Trump. Could bode well for the general.
For a Constitutional ‘expert” it was a deliberate lie by Cruz. If it was the line of the night, it showed how stupid Cruz was to believe he could get away with it. He should have known, IF he is a Constitutional expert” as some claim, that the constitution says “citizens” which Trump’s mother was one. It does not say born of two natural born citizen. A deliberate attempt to confuse the issue...obfuscation. Dishonest!
Cruz people love to be lied to.
During the exchange on NBC, Donald Grump childishly interrupted with little to say and little to offer, he was petulant and out classed. When Cruz offered him the VP and said if Donald was right and Cruz would be DQ'd he would be president it was an overwhelming blow. This was a battle of wits only Grump brought insults and Cruz brought charm, reason and logic.
If he wins the nomination, Donald the Grump will lose to Hillary in the general, those in middle America w/o NY values are turned off by his arrogance and narcissism and those with NY values are voting Hillary.
We have been here before, when Gov. Davis was removed from office CA had the chance to have a conservative governor and instead choose a celebrity impostor. CA has not recovered from their worship of the cult of personality.
For limited government, moral and fiscal conservatives there is one clear choice and one land-mine to avoid. Cruz is the conservatives choice, Donald Grump is Obama without the hatred of America, but still a disaster!
On the face, he would still be eligible for President even if born in Kenya under the Cruz analogy.
The question is mired in a lot of legal mumbo jumbo and application of various laws, cases, circumstances etc.
Why?
The marriage of Obama’s parents was a void marriage. NOT voidable. VOID.
Sr was already married. It was a tribal marriage but a valid one and one that was recognized in the US.
From there, a lot of legal offshoots that cause complicated analysis.
It is not as simple as so many here would have you believe.

I enjoyed how Trump framed the NBC question at the debate.
First Trump highlights how some lawyers think Cruz is NBC, other lawyers say Cruz is not NBC. Who knows with certainty??
The Constitution does not provide a definition for NBC. The Constitution DOES extend to congress the power to write laws to naturalize foreigners. Trump covered that when discussing the illegals!
Then, Trump claimed the questions and ambiguity over Cruz’s head need to be resolved. The potential lawsuit could block Cruz from acting as POTUS. It’s up to Ted to eliminate the uncertainty. After all, the Dem’s love to litigate election results, and Hillary was the first Birther!
Trump throws out that Ted could come along for the ride as his VP nominee. But Cruz remains exposed to lawsuit!
Trump throws out these questions and people can ponder the questions and issues outside of a media filter.
I proffer that Trump is framing the concern such Voters can come to the right conclusion.
IF some folks point to a Cuban father and Canada birth as Cruz disqualifiers, what kind of standard can we build to get unanimous agreement??? What kind of standard blocks lawsuits from liftoff??
I think EVERYONE can agree that:
Natural Born Citizen = US Citizen father, US Citizen mother, baby born on US soil.
I think anyone can see lawsuits challenging Citizenship are doomed for NBC lawsuit targets
I think people will realized lawsuits challenging Citizenship DO STAND a chance, with some % of success, if the target IS NOT NBC!
Why. Did trump move away from the pervert-loving NYC? NYC now protects “transgendereds” so that employers who fail to use the “right” term for one of these folks can be fined $250,000.

I was for Trump as a second choice not too long ago but he doesn’t wear well. I’m finding lately that I cannot stand the man and that I don’t trust him.
That being said, I will vote for him and pray.
