That’s when the legal quagmire delays things even more. If it’s too top secret to be released, how do they show it to an insecure grand jury panel? And they can’t even show it to the Judge in camera without super top security clearance. Just my thoughts/questions.
For the answer to your question look for the recent WashPost article on what happened to Petraeus. He obviously paid a price without being indicted much less a grand jury being involved.
