Ted Cruz Is A 'Natural Born Citizen,' Board (Illinois) Of Election Finds

On the same day he won the Republican Iowa caucus, Sen. Ted Cruz of Texas got a favorable decision from the Illinois Board of Elections, which ruled that he met the citizenship criteria to appear on the state's primary ballot.

Two objectors, Lawrence Joyce and William Graham, had challenged Cruz's presidential bid with the board, contending that his name should not appear on the March 15 ballot because his candidacy did not comply with Article II of the Constitution.

In response to the filings, Cruz's lawyers relied on Supreme Court precedent, legal history and articles from noted constitutional scholars to defend the view that he is in fact "natural born" within the meaning in the Constitution.

Two Presidents that come quickly to mind are Chester Arthur, who became President in 1881, born in Dunham Quebec, and Barack Obama had only one citizen parent. Someone should do an exhaustive study of all the Presidents (and Vice Presidents) and party nominees. I'll bet some interesting stories might emerge. International travel was far less common in earlier days, someone crossing the Atlantic with his family in tow and then returning would have been quite bizarre. Now it happens all the time. There are literally tens of thousands of such births every year, a good portion of the to US military families. The term is not clear in English common law, can sometimes mean natural born "by blood," other times "by soil."

So the courts may some day sort it out. With widespread travel and foreign assignments so prevalent, I'd be shocked if any court didn't take a fairly broad approach. To do otherwise, they'd have to go back to "original intent," which was to keep British loyalists from bringing their progeny, setting a stooge in the White House and re-taking America (as they almost did in the War of 1812).

So the number of threads indicates validity in an argument? So global warming is true based on the number of unqualified scientist signing their name to a petition?

What a dumb comparison. Global warming can be proven or disproven by science. The validity of Cruz's status as a presidential candidate can only be decided by opinion.

You are born one (natural) or you become one (naturalized).

That's it. Two possibilities. It's that simple.

Why are you citing a naturalization law as the basis of citizenship of a person who you claim was never naturalized?

He was not naturalized but, a citizen at birth.
A citizen at birth via an Act of Congress and Congress can only enact laws governing naturalization.

Something for you to consider...
Acquisition of Citizenship
U.S. citizenship may be acquired either at birth or through naturalization subsequent to birth.

Do you understand acquisition in a legal sense? Natural born citizens inherit their citizenship, they don't acquire it.

What’s in the law? You stated that Cruz didn’t have a passport from Canada. That’s not sometinng “in the law,” it’s a fact you asserted, and the fact is independent of any reference to law.


you’ve never read the Constitutional requirements for president or the statute on children born to US parent(s) outside the US????

Go look it up. Its easy to find. I won’t do your work for you. Tho it is amusing you have an opinion on a subject not knowing the law behind it

The Dems are letting Rubio take votes away from the frontrunners to make the field look fractured. They hope Rubio becomes the nominee so they Hillary can win by default.

The law I quoted in post 197 defines who is a citizen at birth and I linked to it.

It does not state who is eligible to become naturalized.
There are only two ways to become a citizen. Two. Just, two.

Article II, Section 2 (can be seen at https://www.law.cornell.edu/constitution/articleiii ) - specifically this part:

The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;—to all cases affecting ambassadors, other public ministers and consuls;—to all cases of admiralty and maritime jurisdiction;—to controversies to which the United States shall be a party;—to controversies between two or more states;—between a state and citizens of another state;—between citizens of different states;—between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects.

In all cases affecting ambassadors, other public ministers and consuls, and those in which a state shall be party, the Supreme Court shall have original jurisdiction. In all the other cases before mentioned, the Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.

If you are not required to be naturalized because you are a citizen at birth, you are a "natural born citizen".

Not all citizens at birth are natural born citizens.

See state.gov link at 266 regarding...

Acquisition of Citizenship

State.gov...think about it.

I used to be on the fence with Trump, but I’m having more misgivings and suspicions about his legitimate conservativeness every day. I believe he’s going to slide back into being a liberal/moderate after the election is over.

Even with Rubio’s flaws, he’s a more legitimate conservative than Trump is.


Oh barf, I’m sure you were on the fence with Trump.

Rubio has talked non-stop about building a wall on our southern border.

Rubio has said he’ll deport all of the those here illegally.

Rubio has done so much for our vets.

NOT!!

Anyone who supports Rubio cannot possibly support the above conservative positions....that are Trump’s.

I testified at a legislative committee hearing in Nebraska saying that very thing. I said we have a lot of up-and-coming politicians for whom this will be an issue, and it’s not fair to them or to anybody else to leave the question hanging. I specifically mentioned Cruz, Jindal, Rubio, and Schwartzneggar.

So what? There are 5 million Jews in America who can go to Israel tomorrow and get an Israeli passport. The same is true for a few other countries. It doesn't mean they aren't natural born citizens. Neither one of my US-born parents (Both born to immigrants) had a birth certificate, but they voted in every election. Were they citizens? They thought so. Were they "natural-born?"

After reading the law its clear this is a political tactic by trump to win by any means necessary even lying.
