Is Cruz laying in the weeds just waiting to put this issue to rest? Maybe, I can’t tell. He may need someone to sue in order to put it to rest, I don’t know. Constitutional scholars with a lot more knowledge than I disagree on the issue.
Trump isn’t going to sue, read his language. He didn’t say I’m going to sue, he said “I have standing to sue”.
He wants to raise suspicion, which is a smart move politically.
It’s up to Cruz to decide how to handle that.
One does not have to be a ‘Constitutional Scholar’ in order to be able to discern the meaning of its (the Constitution) words.
Most of its precepts are simple enough that any person of average intelligence with an ability to read English can comprehend the intent of its Authors.
How to handle that:
As a non-attorney I can't claim to fully understand "standing" but after eight years of watching virtually every kind of plaintiff conceivable thrown out in suits against Obama I may have learned some things. I gather standing requires either actual or significant potential harm. Trump's claim to standing is being on the same ballot as Cruz. There'd be no harm if no one thought Trump had a chance to win; e.g. Jim Gilmore wouldn't have standing to sue over Cruz being on his ballot. There'd also be no harm if the allegedly ineligible candidate had no chance to defeat Trump, again e.g. if Gilmore's eligibility were in question. So Trump to claim he has standing to sue over Ted's eligibility means Trump is admitting there is a significant chance Cruz can beat him. If my legal logic is correct, that is a response Cruz can make. Trump doesn't want to admit ANYONE can beat him. To be shown admitting that would be like when Cruz showed that by some birther theories Trump himself was ineligible. That did surprise and rattle Trump, although he responded better to Cruz's next punch on 'NY values.' Cruz needs a better second punch this time with some variation of "shut up or put up" being one option.
