Senior U.S. Supreme Court Associate Justice Antonin Scalia found dead at West Texas ranch

Associate Justice Antonin Scalia was found dead of apparent natural causes Saturday on a luxury resort in West Texas, federal officials said.

Scalia, 79, was a guest at the Cibolo Creek Ranch, a resort in the Big Bend region south of Marfa. According to a report, Scalia arrived at the ranch on Friday and attended a private party with about 40 people. When he did not appear for breakfast, a person associated with the ranch went to his room and found a body.

U.S. District Judge Fred Biery said he was among those notified about Scalia's death.

"I was told it was this morning," Biery said of Scalia's death. "It happened on a ranch out near Marfa. As far as the details, I think it's pretty vague right now as to how," he said. "My reaction is it's really unfortunate with any death. And now, politically, in the presidential cycle we're in my educated guess is nothing will happen before the next president is elected."

Within hours of this man’s death, they report it is from “natural causes”? Did they perform an autopsy? I thought autopsies take weeks for results to come back. What is going on?

From the Constitution: He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

This one will go to the voters in November.

Napolitano said that the only way anything gets to the Senate floor is if McConnell puts it there. It’s entirely his decision. So he could set any nomination aside for as long as he wants.

If that’s true, and Judge Napolitano is usually right, we don’t need to count on, and hope for, the whole Senate to do the right thing. Best thing is for McConnell to do the right thing, sit on any nomination for a year, and then put it in front of the Senate.
