Vanity: Remember Cloture Rule Still Applies to SCOTUS Nominees

Just a reminder the Cloture rules requiring 60 votes to end debate in the Senate still applies for SCOTUS nominees. Yes Harry Reid dropped the nuke for executive appointments but exempted SCOTUS nominees. If 40 GOPers stand strong the nightmare of Obama getting to replace Scalia shall not pass.

Lyndon Johnson's nomination of sitting Associate Justice Abe Fortas to succeed Earl Warren as Chief Justice was successfully filibustered in 1968.

I’d think Eric Holder or Loretta Lynch.

They were both confirmed by the Senate for AG, so no way they wouldn’t be good to go on SCOTUS.

I'd say no, Bork was knocked out of contention in committee. Others would say that counts as a filibuster. All depends on how one defines "filibuster."

In the summer of 1968, Sen. Strom Thurmond (R-S.C.) opposed President Lyndon B. Johnson’s choice of then-Justice Abe Fortas to the top spot on the Supreme Court of chief justice. (In the Senate, one senator can block just about anything.)

Thurmond’s rationale for blocking Fortas’s promotion was was both parliamentary and political. Johnson, who wasn’t running for reelection, was a lame duck. It was just six months or so before the presidential election that Thurmond’s party had a good chance to win.

What it boils down to is that they will find a way to convince us that they oppose it, but can’t stop it, and it will happen.

Since McConnell has already said it won’t happen, I can see the new appointee (scary? Holder, Mooch, Sharpton, Clintoon) being seated BEFORE baseball season opens.

I PROMISE you, that I will take off from work and fly to any state to fight against ANY republican who dishonored Scalia’s name by doing that.

He was a GREAT man and a personal hero and I am one angry Italian American tonight.

My memory is long and my anger at traitors lasts longer.

Yes, of course. But the SCOTUS was originally constituted with 6 justices. A panel of fewer than that can operate.

Its time to permanently neutralize this lawless bunch of degenerates who call themselves the Supreme Court.

NO SENATE VOTE ON ANY nomination by the communist ANIMAL in the White House, then 7 new appointees by Trump bringing the number to 15, thereby taking this current menagerie of homosexuals,eggheads, marxists and blackmail victims out of any position to stop a hard right agenda to make this country great again.

Please believe me when I tell you I share your anguish and your anxiety concerning Justice Scalia and Justice Scalia's seat on the Supreme Court.

I doubt very many Rino Republicans of the Mitch McConnell stripe fear the wrath of outraged conservatives when they survey us and observe us trashing Ted Cruz and whoring after Donald Trump. They see how we abandon our champions and how fickle we really are. They see how we have abandoned the one man who stood up all night on his feet on the floor the United States Senate and fought on our behalf. Worse than abandon him, conservative after conservative have traduced him.

Mitch McConnell knows that he'll cut a deal with Donald Trump and the music will play on while we conservatives eat our own.
