Alberto Gonzales, Attorney General of the United States under President George W. Bush, said on Monday that President Barack Obama had an "obligation" to fill a vacancy on the Supreme Court.

Following the death of Justice Antonin Scalia, Republican presidential candidates and other party leaders argued that President Obama should not attempt to fill the vacancy in his last 11 months, and that the next president should make the appointment instead.

Another reason to dislike the Bushes and all their minions. These people are at best clueless and at most traitors to the country. If this was a Republican president, the Democrats would be screaming not only no, but hell no and would not schedule a vote. Cue the clueless Bush faction of the party who continually talks about government in terms that works and always views public service as noble while the country is being torn down all around us.

He does have an obligation but, the Senate has the responsibility of Advise and Consent and they should not consent to whichever asshat he pushes on us...

obligation to “nominate” not to “fill”.

I would argue that the president and senate have an implied obligation to work together to fill the position with a mutually acceptable justice. But the only explicit obligations are for Obama to nominate and the senate to confirm or reject.

Agree. But my point is these Republicans have no concept of strategic negotiation. They immediately cede the ground. Instead of yelling loudly that Obama shouldn’t even nominate anyone, they invite him to and they immediately give him the opportunity to take advantage of the nomination. Would you ever hear a Democrat say that a Republican president has the obligation to fill the vacancy?

The Senate GOP has an obligation to not approve any nominee.

If they fail, there is no point in the GOP existing.

In 2007, Schmukie Chuckie said that the Senate Democrats (who were then the majority) would not consider any SCOTUS nomination made by Bush. Of course, Schmukie Chuckie has flipped-flopped now that the parties have switched places.

IF Obama nominates his first choice, Srikanth Srinivasan, the Senate/TEd Cruz is screwed because all the GOP senate voted to confirm him before.

Ted Cruz voted to confirm Obama’s favorite for Scotus, Srikanth Srinivasan to another court.

Cruz, who clerked with Srinivasan at the 4th Circuit Court of Appeals, quipped, “I am hopeful that our friendship will not be seen as a strike against you by some.”
