This is all fun stuff and will no doubt lead to some very clever jokes on The Daily Show. But there were also some very serious legal questions at stake. Namely, what limits does the U.S. Constitution place on the legislative power of state governments, and what role do federal judges play in enforcing those limits? Related to that, what sort of unenumerated rights (if any) are protected from state infringement by the 14th Amendment?

No.

There are not nearly resources to defend every lost State case to the Supreme Court which accepts a tiny fraction of legal cases compared to the rest of the Federal court system.

It was a prudent use of Texas taxpayer dollars.

Well done Ted Cruz!

What conservative legal values are involved here? Violating individuals rights? This is just another example of the effects of the loony right trying to enforce “their views” on the whole of Texas’ citizens. I guess with Lyin’ Ted extramarital sex is o.k., but purchasing (but not using) a sex toy for yourself or your partner isn’t. I’m just waiting for Lyin’ Ted to come out in favor of “Snake Handling” on Sundays!

I don’t think any ‘politician’ or ‘government official’ has the right to be in the ‘citizen’s bedrooms’...

Cruz is a total hypocrite on this, his mistresses, his hooker, what you think they go there and have just sex and zip up and leave? From what I’ve been hearing, there’s chains, whips, men put on women’s panties, dress up for the ‘payee’ and all kinds of things...good heavens!!!

He isn’t qualified to be a Senator much less a Presidential Candidate, what Texas does after all the lies, and crap that have come out on this man is up to them, but we need to tell the people: ‘you don’t belong in our bedrooms’ and no, I’m single, 71 years old, and do not preform in such a manner, my Catholic Grandmother would come out of her grave and swat the heck out of me for such things...

The tenth amendment.

Why does the Federal government get to decide every issue in the world?

Maybe we should have a limited Federal government and the unspecified powers remain with states.

if people don’t like their state’s view of sexuality then they can move.

I also think there is a basic safety issue. Why should people be able to sell body penetrating materials at in home tupperware sales?

There actually are real dangers that emergency rooms deal with on a regular basis.

Why can’t states regulate that danger like wearing a motorcycle helmet?

Doesn’t sound like conservative legal values to me.

Cruz would allow states to micromanage every aspect of our lives, even as he supports political party leadership holding sham elections and denying voters their rights.

Cruz chose states rights over privacy rights when the state had absolutely no interest in interfering with privacy rights.

There’s no scriptural prohibition.
There’s no sanctity of life issue.
There is no known link or association with child abuse.
The state had absolutely no legitimate interest in interfering with personal privacy in this matter.

Cruz doesn’t have the common sense necessary to be President.

I do too. It will be a perfect excuse to illustrate the idea of federalism. Texas should be allowed to regulate (or not regulate) dildos. Colorado should be allowed to regulate (or not regulate) marijuana. New York should be able to regulate (or not regulate) soft drinks. California should be able to regulate (or not regulate) automobile emissions. North Carolina should be able to regulate (or not regulate) public restroom use, etc.....
