Byron York: Heidi Cruz says 'Ted is an immigrant'

GREENFIELD, Ind. — At a campaign stop just days before the critical Indiana primary, Heidi Cruz, wife of Republican presidential candidate Ted Cruz, said one of her husband's strengths in the campaign is that he "is an immigrant."

"Ted is an immigrant," Mrs. Cruz said, emphasizing the word "is." "He is Hispanic."

Just like the last alien power climber. Then poor Granny got “pillowed.”

No kidding, she is off limits for interviews, but she has made appearances with Heidi in Wisconsin.

From what I have learned thus far:

1. She is an American that married in Texas and moved to England.

2. Lived there six years or so and returned to USA

3. Moved to Canada with Ted’s dad and lived there eight years or so.

4. Had Canadian citizenship because she was interviewed by two official Canadian Provincial enumerators that verified both their ages and placed them on the list which was sent to everyone in their precinct.

People may have been intentionally or unintentionally left off the poll list, but those on it were eligible and verified as Canadians over the age of 18.

5. No Canadian or American needed a passport to travel from CA to USA by car or plane in 1974 or 1975. All the mom needed was a Drivers license and who is to say if your going on vacation and you just never return to Canada.

6. No idea how they were taxed, doubt they would have wanted to pay both countries. Nice having free Canadian health care and not purchasing private insurance from the USA. Nice for Rafael not having to serve in the Vietnam War.

At the bottom, in the notes, it says that Eleanor had a US passport and gives the number. It’s dated 1966.

So up to 1966, she was a US citizen.

The question then is, what happened in Canada in regards to Eleanor’s citizenship?

Like I said, there seems to be some question about the validity of the passport number. Also, Mr Wilson has claimed this was not his child as they were divorced.

Actually it makes no difference whether or not Eleanor expatriated her own natural born U.S. citizenship before or after Ted Cruz was born with respect to his eligibility for POTUS, because the U.S. Supreme Court correctly observed no person born abroad and outside the jurisdiction of the United States could acquire natural born citizenship: United State v. Wong Kim Ark, 169 U.S. 649, 18 S.Ct. 456, 42 L.Ed. “A person born out of the jurisdiction of the United States can only become a citizen by being naturalized....” At most Ted Cruz may or may not be a naturalized U.S. citizen, but there is no possible way he can be a natural born citizen of the United States.

The only significance Eleanor’s retention or expatriation of U.S. citizenship can play now is whether or not Ted Cruz is a lawful naturalized citizen or an illegal immigrant from Canada with fraudulently obtained U.S. citizenship who is not eligible to be in the U.S. Senate.

Again, the "natural born citizen" qualification is in our Constitution. I would not tell you that if I wasn't sure that it is in there. You can find it.

The Constitution is the Constitution. There are no other provisions in the Constitution or in any of its amendments that refer to positive or natural law. Similarly, you will not find the terms Catholic or protestant in the Constitution.

So, I am looking to the Constitution for the standard. It says "natural born citizen." I believe that if they meant something more or something else, they would have said so.

Impeachment from his Senate seat is called for if this is true.

Expulsion, not impeachment, is for members of Congress. Only the member's house decides on expulsion and a two-thirds vote is needed for expulsion.

That is a false strawman argument. Delegates vote on who will or will not be the Electors responsible for electing the President of the United States in the Electoral College.

Since Cruz renounced his Canadian citizenship, about the only place to deport him to would be Cuba. If he can survive the raft trip over here again, we can get the legal process in order for him to be a citizen.

Well, when you read the Constitution, you will find that it is electors who choose our presidents. In modern times, electors are selected in all states by the voters. However, the Constitution leaves it up to the state legislatures to determine how each state chooses electors. They have chosen to let the voters to vote for electors. And, thus, it is important that voters consider the qualifications of candidates for president. Please, take that job seriously - no exceptions!!
