BREAKING: Obamacare Suffers Major Blow With Subsidy Payment Strikedown

A federal judge has ruled the federal government has been inappropriately paying out Obamacare subsidies, which House Republicans sued over. The lawsuit argues the Obama administration is spending money that was never allocated by Congress.

According to this article, the ruling only pertains to the cost-sharing reduction payments to the insurance companies and not to the subsidies given to low-income people. Companies would raise premiums to cover the loss of these government payments, but the subsidies to individuals would then be increased to offset that. So, no real change in the program.

According to Chief Clown Roberts there’s no difference between “Exchange established by the State” and “Exchange established by the Federal government”.

but this will be appealed and will end up in the SCOTUS, where guess what will happen.

This is a major domino to fall. These subsidies were keeping many of the exchanges tethered by a thread. Now even that will be going away. The economics just do not work. Anyone with a modicum of logic can tell you that. The infirmed will of course flock to ACA and sign up eagerly with on pre-condition restrictions. And they’re going to use a disproportionate amount of the available resources. Who can blame them?

Bath House can spend whatever he wants, because melanin and because Ryan, Boner, and The Gobbler.

There is no rule of law anymore. The Constitution is kaput. The republic is gone, being replaced first by a democracy and then by an oligarchy.

Congress ceded its power to the executive branch long ago.

This decision won't stand.

Where is John Roberts when you need him?

Right, “cost sharing reduction payments” to help low-income people with lower deductibles and co-payments, but the ruling doesn’t affect the direct tax credits to lower their premiums. Those will continue, according to what I’m reading about this.

Maybe because a lawsuit can actually accomplish something, but impeachment can’t accomplish anything?

You might love symbolic gestures, but I would rather have actual victories.

This is why this is only a temporary win at best. The lawsuit was brought and hinged upon a technicality, a phrase in the ACA law that utilized the term “state” inappropriately. All that really needs be done is a new law written to correct the oversight.

So this could be good if Trump is true to his promise to “get rid of Obamacare”. This will provide the opportunity to do so. However getting a new law passed will be a huge hurdle to overcome. We will see how much he is willing to “deal” (assuming he is elected).
