Feds Order Colleges to Stop Checking Criminal/School Discipline History (tr)

The Obama administration has ordered the nation’s colleges and universities to stop asking applicants about criminal and school disciplinary history because it discriminates against minorities. Institutions are also being asked to offer those with criminal records special support services such as counseling, mentoring and legal aid once enrolled. The government’s official term for these perspective students is “justice-involved individuals” and the new directive aims to remove barriers to higher education for the overwhelmingly minority population that’s had encounters with the law or disciplinary issues through high school.

Instructions are outlined in a cumbersome document (Beyond the Box) issued by the U.S Department of Education (ED) this month. It says that “data show plainly that people of color are more likely to come in contact with the justice system due, in part, to punitive school disciplinary policies that disproportionately impact certain student groups and racial profiling.” Because education can be a powerful pathway to transition out of prison and into the workforce, it’s critical to ensure that admissions practices don’t disproportionately disadvantage justice involved individuals, the directive states. Colleges and universities should also refrain from inquiring about a student’s school disciplinary history—including past academic dishonesty—because that too discriminates against minorities. Civil rights data compiled by ED show “black students are suspended and expelled at a rate three times greater than white students and often for the same types of infractions.”

Therefore colleges and universities should consider designing admissions policies that don’t include disciplinary history so they don’t have the “unjustified effect of discriminating against individuals on the basis of race, color, national origin, sex, religion and disability,” the new ED guidelines state. Three out of four colleges and universities collect high school disciplinary information and 89% of those institutions use the information to make admissions decisions, according to the order.

The Education Department "Beyond the Box" document is here. The letter by the "human rights major" at an Ivy League school on page 3 is interesting. He or she is upset about being asked about a criminal record, even though he or she was admitted.

Well, whatever The One did in high school did not seem to affect his chances for college and the career he chose afterwards. Kind of strange that this is being done now, lol.

If colleges are banned from asking about students’ criminal records, how will they know which students are criminals who need “special support services such as counseling, mentoring and legal aid”?

Asking about criminal history discriminates against minorities, but setting up special support services discriminates against those with non-criminal history.

We have attained Animal Farm: All are equal, but some are more equal than others.

In 1968, I was aspiring to a Regular Army commission as a Second Lieutenant of Infantry (these folks were in great demand in those days). I had to appear before a board of Officers to explain the circumstances of my arrest in Fayetteville, AR on the evening of the Arkansas - Texas football game wherein Arkansas who was ranked number 2 in the polls and Texas was ranked number 1. Arkansas won. As far as I can remember, I was guilty.

After deliberations, the board decided that I was good to go proceeding to kill Communists. I learned how to do this and did it quite well.

I killed a lot of Commies. I was able to certify that they were indeed dead and that they were clearly members of the North Vietnamese Army. Sometimes I had to get my soldiers to break out their entrenching tools out and bury these commies as well as they could, but sometimes we got help from the Engineers with bulldozers. Either way, they received a proper burial.

I have nothing against the individuals, but they were working for the wrong side. Sucks to be them.

Despite the press reports, we were much better that these bozos.

The Guaranteed Student Loan program will not allow any student with a felony to receive federal grants or loans. So how can the Obama Administration and US Department of Education state no criminal history background checks. Another thing is selective service registration for adult males at age 18. So a male student whom does not the Selective Service Registration is unable to receive federal funds. How is this to be guaranteed.
