It is not illegal to use cell phones while driving. So, it is up to the prosecution to prove that the driver was distracted. More than 40,000 people die in automobile accidents each year. Fact of life.

“It is not illegal to use cell phones while driving.”

If anyone cannot drive and talk on their cell phone at the same time because they become distracted then they have no business getting issued a driver’s license.

Should be a DUI (Driving Under the Influence) The phone was causing her not to pay attention. This is going to get worse.

It is not illegal to use cell phones while driving.

In California and Nevada, yes, unless it is a hands free device.

Correct. I recently had a court date a month ago at the LA courthouse and I learned about this from my atty. Dismissed. Never mind about the specifics of my violation...

It is in California, unless the driver is totally hands-free, which means voice commands.

You never saw a car weaving and becoming a menace with the driver playing on the phone?
