Because that is why Hillary created the private e mails in the first place has always been my theory. The private and separate server enabled Hillary to e mail Obama and others at the top, without fear that others in her own state department and people within our OWN government would see them because they are also TO and FROM Obama himself.
Hillary and Obama, although they hate each other, are deeply in cahoots due to mutual blackmail capabilities.
I have said since the beginning that to my husband that the very reason that Hillary created the private e mails was keep her cohorts in the state department from seeing them!
This could all unravel quickly. We need an independent prosecutor and the FBI has to recommend an indictment LOUD and CLEAR. The FBI might be corrupted as well.

Use of non-government lines of communication for government business is against regulations, and if the communications are classified, criminal.
Obama communicated with Hillary using her private server as the recipient. She'd call him as a defense, that he approved of the arrangement, therefore tacitly waiving application of the regulations and laws.
