The present state of affairs goes nowhere. Comey laid out some dozens of instances of black letter violations of 18 USC, under which “intent” is not relevant nor is it even mentioned in the statute.
The “content” of top secret and above top secret info she (mis)handled is irrelevant, the intent of the misplacer is irrelevant. The info was brought to an unsecure location, eg; her server. That and that alone is the violation. If that does not cross the line, there is no line. She also lied to Federal investigators, also a felony. There’s nothing to discuss here. She achieved every single element of the violation and it’s not being reco’ed for an indictment. Those are the only applicable facts, like them or not.

SOMEBODY stripped those emails of their classified markings and transcribed them into Clinton’s private email system. That seems like an deliberate act to circumvent the system. The FBI has the threads. They know who did it. Does The FBI intend to give them a free pass as well?
