During testimony before Congress on Thursday, FBI Director James Comey stated that the FBI’s interview with presumptive Democratic presidential nominee former Secretary of State Hillary Clinton was not under oath or recorded, but it still would be a crime to lie to the FBI.
Comey stated that he did not personally interview Clinton, and did not talk to all of the “five or six” who did interview Clinton.
He was then asked, “did she testify or talk to them under oath?” Comey answered, “No.” But added that “it’s still a crime to lie to us.”
When asked if there was a transcript of the interview, Comey stated that there wasn’t one because the interview wasn’t recorded, but there was an analysis of Clinton’s interview.

I don’t understand why they give the so called political elites like Hillary an out, with no sworn testimony and no transcripts.
But then when it comes to justice why are not all citizens treated the same? Why were Bush and Cheney also given a pass with their 9-11 testimony of no swearing in and no transcripts and no separate testimony?
DOJ-FBI "counter-terrorism" "efforts" are nothing more than the same Kabuki theater America just suffered and witnessed by the lawless and corrupt Obama/Lynch/Comey FBI.

And because we know it's a crime and we know she didn't have criminal intent we know she wasn't lying. And so there was no need to put her under oath or record what she said, since we knew it was the truth.
This is gross incompetence on the part of Comey. He should resign for the good of the country. To not put her under oath and video tape the interview is derilection of duty.
Did you see how quick Comey said Patreaus was as guilty as the day is long and what he did was a lot worse than Clinton!! I almost passed out. What a stooge of an FBI director. If Trump is elected hopefully Comey puts in his papers.

You are correct. Miranda only kicks in if it is a custodial interrogation, i.e. post-arrest interrogation at station, being haled in for questioning, etc.
This is why police favor casual or voluntary encounters. It’s where they get the most protection in questioning suspects. You’d be surprised how many people will invite police into their homes, give them coffee and cookies, and confess to crimes with zero coercion.

You are right. He was originally arrested on several charges the most serious was lying to the FBI. He was ultimately able to cut a deal he agreed to plead to structuring and that was the only charge submitted to the Grand Jury, a charge to which he immediately plead guilty.
The case is being made for civil war.
I amy be wrong, but prior to charges being filed, you have the right to remain silent. I wouldn’t agree to talking under oath absent criminal charges. As a defendant, it’s never good to create evidence.
It does seem odd that they didn’t record the interview. It’s almost like they knew they would never need it for reference or something. /s
