I’m definitely not cheering for the homeowner, but couldn’t he be facing charges of second degree murder for this?
Possibly even first degree, if he ends up being prosecuted by a first rate and aggressive prosecutor. How do you prove, in this situation that you didn’t intend to kill somebody? You planned it all.
He didn’t intend for the criminal to die... just tied him up until the police could get there.
On the lighter side think of all the people who WILL NOT be damaged because this thug is dead...
Negligent homicide- no intent
2nd degree- intent to harm w death foreseeable.
1sr- intent to kill
There was no marks on the body. Unless he poisoned the man. They haven’t done an autopsy yet.
