The curious question the BATFE refuses to answer:
How many legal _post-’86_ machine-guns are in private hands?
There _is_ an exception in 922(o), allowing a private purchase if vouched for by a suitable government agency. There are rumors and indications that strings get pulled, backs get scratched, and favors exchanged to make those sales happen legally; these would be done very quietly, leveraging the fact that such ownership is a private tax matter and the BATFE is obligated to keep those records secret. Such waivers would allow purchase of new machine-guns at “list price” (say, an M16 for $750, vs used transferrable at $25,000), rare guns (AFAIK there are only 3 publicly legal Glock 18 machine pistols in the USA commanding $250,000 each), and otherwise completely unavailable guns (say, FN P90). Of course, there is no apparent way to get a list of who has such “waiver” machine-guns, and the BATFE won’t even admit (nor deny) that such purchases happened.
There is a movement to get 922(o) repealed/revoked. I’m not sure how that’s going, as it requires great legal precision to pull off either by legislation or litigation. Finding out who got waivers would go a long way to destroying 922(o).
There is also the possibility of an empowered public official openly issuing such waivers. Would probably get his career wrecked, but some will stand up for principle if made aware of this option. Imagine: President Trump declares “for starters, and in light of historical American values embodied in the Second Amendment and facilitated by the likes of the Militia Act Of 1792, I hereby issue upon request to every Selective Service-registered citizen the 922(o) waiver required to purchase, keep, train, and bear their own select-fire M4 carbine; given that the ‘right of the people’ extends beyond just draft-age males, I also will issue upon request the same waiver for every American citizen of draftable age and older, any gender, who do not have a felony record and can otherwise pass an NFA Form 4 application.”
Don’t just fight to keep RKBA functioning at the line it’s at. Use the Left’s tactic of demanding far more - you might just get it, and certainly something less but still better than where we are now. One gutsy President, Governor, or even CLEO could inflict a devastating blow upon 922(o), and in turn upon NFA (by making full-auto “normal & common” insofar as paperwork allows).
