‘America’s toughest sheriff’ kept racially profiling Latinos, now faces criminal prosecution

A darling of the far right and a longtime adversary of civil-rights groups and immigration activists, “America’s toughest sheriff” will soon face Justice Department lawyers in Washington in a years-long legal saga over whether he intentionally defied federal orders to stop racially profiling Latinos.

A special section of the Justice Department — dedicated to investigating corruption in publicly elected offices — will decide whether Maricopa County Sheriff Joe Arpaio should face criminal contempt-of-court charges, according to a ruling filed in U.S. District Court on Friday.

The decision followed several other blows for the Arizona sheriff in the protracted case. In May, U.S. District Court Judge G. Murray Snow ruled that Arpaio and his aides — Chief Deputy Jerry Sheridan, Capt. Steve Bailey and his former attorney, Michele Iafrate — had intentionally ignored federal orders to stop racially profiling Latinos at traffic stops and in “saturation patrols” of predominantly Latino neighborhoods.

On Aug. 19, Snow referred the sheriff and three of his associates to be prosecuted for criminal contempt of court.

The decision was almost without precedent, so unusual that even the Justice Department initially seemed unsure of what, exactly, would happen next.

Arpaio vowed to challenge the referral and will refuse to accept a plea agreement or resign as sheriff, his defense attorney told The Post. It is unclear what lasting consequences the threat of criminal prosecution will have for the Republican sheriff, who is unlikely to be jailed and is up for reelection in November.

Legal experts said Snow’s referral was a symbolic one: Even if Arpaio is prosecuted, contempt of court is a misdemeanor that carries a maximum of six months in jail, and it is not likely that Arpaio would spend much time behind (his own) bars.

“Down in the article they get around to admitting that Snow’s action is only “symbolic”...right before Arpaio’s primary election, of course!”

“I love how a criminal can be on video and have 20 eyewitnesses that all saw him committ the crime and the press will still use the word “allegedly”. “

The article never accused Joe of anything. No place to use ‘allegedly’.

The title of the article says Sheriff Arpaio “kept racially profiling Latinos”...which is the alleged “crime” that WaPo has already convicted him of committing in the title without even using the term usually required term alleged!

I am so sick of this purely political federal persecution. Joe is one of the few that actually enforces the law, and will have my vote as long as he asks for it... My mail in ballot was sent in a couple weeks ago and I voted for him in tomorrows primary and he has my vote in the general too. I am patiently awaiting results, hoping Joe goes on to the general and that McCain gets retired!

How does one stop reality? Who does not believe, that a whole lot more defying of federal orders needs to be going on. Fifty Governor’s and not a spine in the bunch. So if I say you are a latino I’m guilty of racial profiling? The problem is you are an illegal alien and just happen to be latino or latina.

Wah-poo took on the PG county po-po’s a decade back for much the same thing. That spin cycle left out (neglected to report) 2 important facts:

1. The PG county police dept was predominantly composed of African Americans (i. e. Black Officers) and

2. PG county was 80% black.

This entire phony case against Arpaio is directed by a Mormon traitor named Judge Murray Snow who speaks fluent Spanish and did his missionary work in Mexico, and should have been yanked from the case on day one

The federal judge who made this criminal referral of Sheriff Arpaio is U.S. District Court Judge G. Murray Snow.

“Judge Snow was born in Boulder City, Nevada. He received a Bachelor of Arts degree from Brigham Young University in 1984. He received a Juris Doctor degree from J. Reuben Clark Law School at BYU in 1987.

Snow was nominated by President George W. Bush on December 11, 2007. He was confirmed by the United States Senate on June 26, 2008, and received his commission on July 23, 2008.”
