Does anyone know the scenarios here? If they find wrongdoing can she get convicted as a nominee or as a Prez if she would win? Can they even run a candidate who is being investigated by the FBI? Would Kaine (eye roll) become the nominee or the Prez if that happened? Can they extend the election til after the investigation?
Taking them in order.
1. Being a candidate or a president does not by default grant immunity prosecution. With that said there’s nothing that says she can’t pardon herself if elected.
2. If HRC were to be imprisoned or resign her candidacy before the election, the dem party would select a replacement. Kaine would be a possible choice but is in no way a legal requirement. If she resigns or is impeached after becoming president, VP Kaine would take over per the constitution.
3. I know of no legal provision to delay the election.
