Obama Has Not Ruled Out Pardoning Hillary

President Barack Obama has not ruled out pardoning Hillary Clinton before he leaves office in early January despite her not being charged with a crime.

"The president has offered clemency to a substantial number of Americans who were previously serving time in federal prisons," White House press secretary Josh Earnest responded Wednesday when asked by reporters.

Free advice for President Trump.
Have attorney General Rudy conduct a full investigation of the emails and Clinton Family Foundation. Lay the whole stinking mess out for the public to see. Bring charges against all the major players.

All of Hillary's aides, all the democrat politicians, but then pardon Hillary. No need to go after her, just expose the criminality. It will make Trump look like the bigger person and take the edge off the “its all political” charge. The dims are never going to forgive her for losing, besides she'll suddenly be a sick old lady, victim of political payback.

Meanwhile, destroy Huma, McCauliffe, and all the dims that have any potential political future, and the businesses that may have violated the law. Seize all the cash and property of the Foundation and use it to help pay for the wall. I know you can't do the latter but it would be fun to watch libs head explode.

If The Former Twelfth Lady has any illusions about 2020 she will demand that he not issue any pardons to either her or to BillyBob.She knows that any such pardon would end any dreams that she might have.OTOH,if she’s resigned to the fact that her career is over she would almost certainly demand that he does issue pardons...to both of them.

Trump should not rule out investigating Obama and if there is wrong doing he should be prosecuted.

If Obama pardons Clinton he cannot pardon her of every possible charge. She can be pardon for specific charges but not all possible charges. Clinton can still be prosecuted under charges not mentioned in the Obama pardon.

I strongly would recommend Obama stay clear of this and let justice be done.

If he were to issue a general pardon for Clinton for all crimes she may have committed: (1) It would elevate Clinton’s scandals to the level of Watergate and forever group Clinton with Richard Nixon; (2) It would forever Tarnish Obama’s legacy. In a way his administration would be in a class by himself, as far as corruption. Ford had few connections at all to the Nixon administration, and his pardon of Nixon was for the good of the country after Watergate had been thoroughly investigated by an Independent Counsel. Clinton was a big part of Obama’s administration, so Obama pardoning her would be an admission that his own administration was corrupt and lawless and could not withstand the scrutiny of an independent investigation.

The power of the pardon as defined in the Constitution is almost unlimited and has remained so for the last several hundred years because even the most cynical and corrupt of politicians have shied away from abusing it's awesome and unlimited power to forgive.

Until Bill Clinton, of course.

Bill Clinton abused the power of the Pardon so badly ( the roots of Clinton's Post Presidential white collar RICO crime organization has it's roots in the payoffs, favors, corruption and connections arising from his Pardon fiasco) that there were serious move to fight the pardons in court all the way up to then Supreme Court or change the law to restrict the pardon power of the President.

If Obama seriously abuses his Pardon Power to protect Clinton and her cronies who may be shown to have committed treason when all the facts finally come out could actually cause the cases to be litigated all the to the Supreme Court and may end up modifying the current scope power of the Presidential Pardon via Supreme Court decision.

Can't pardon someone without a Judicial Conviction and since Hillary has never had a Judicial Conviction Obama can't pardon her.

What is happening is that the Press is still trying to help the Demorats to get her off any future convictions. The only problem is that it involves National Security (Secret and Classified Documents leaked by her carelessness) and Corruption (Pay to Play in the State Department).

Any pardon by Obama would damage the Government of the United States and I wouldn't put it past him.

It doesn't take a lawyer type to answer your question.

Just read the history of the President Gerald Ford pardon of President Richard Nixon and you will be able to answer it yourself.

Of course at the time of the Nixon pardon the country was aghast at Nixon's transgressions.

But that was then and this is an entirely different world where a high level of criminality among politicians is taken for granted..

Nixon's cover-up compared to Hillary's criminality, lies, duplicity and scamming is like comparing a kid caught with his hand in the cookie jar to Joe Stalin.

Nevertheless, Nixon was pardoned without ever being formally charged or convicted of any crime.

Exactly. I think a pardoned person cannot take the fifth (much like immunity, especially if the pardon is quite broad as it usually would be). If she is called under oath she would need to answer and perjury that time can’t be part of the pardon. That’s my impression; lawyers should correct me if I am wrong.

You are wrong. She doesn’t have to be charged or convicted of anything.

A president can issue a blanket preemptive pardon.

You are wrong.

A president can pardon anyone for any Federal crime whether or not there has been any legal action.

I hope Obama doesn’t figure out that he would be doing Trump a great favor if he pardons Hillary.

Without a pardon President Trump would have to make a decision as to if he will or will not actively pursue an investigation against Hillary.

If he does he will be attacked from the left for being petty and vindictive.

If he does not he will be attacked from the right for not keeping his word and for letting Hillary get away with her crimes.

But if she is pardoned by Obama Trump will not have to make that decision and he can spend his time implementing his agenda.

Should Hillary have to answer for her crimes?

Of course the answer is yes.

But an Obama pardon would make that a moot point at the presidential level and take Trump out of the line of fire.

If Obama issues a pardon before a Grand Jury gets to see all the evidence, then the people of the United States will realize that he is part of the criminal gang.

For every lawyer who argues a position, there is another lawyer who will argue the opposite position.

Reminds me of the story of the small town that only had one lawyer who was starving until a second lawyer moved into the town.

Two things: I believe if one has received a pardon, then they cannot invoke the 5th at a future testimony. If she is called to testify, then she must or be held in contempt.

Secondly, I believe that charitable foundations are subject to the laws of the states in which they are chartered. If this is correct, then the CF violated state laws up the wazoo and any presidential pardon she was given would not apply to violations of state laws.
