Problem: Two of your quotations are from before the Civil War. We fought that one, and lost. The Feds rule.

Interestingly, the Feds do not rule when it comes to insurance matters. There have been key Supreme Court decisions that clearly reaffirm the status of an insurance policy as a contract, not "interstate commerce" -- which puts it under the authority of a state, not the Federal government.

That's one reason why ObamaCare was such a mess. It was set up as a Federal mandate, but could only be implemented through insurance carriers that come under state regulatory oversight.

This is one reason why I am adamantly opposed to Trump's idea for an open national insurance market. There's nothing wrong with an insurance company in Iowa selling an insurance policy to a customer in New York, but it's going to have to meet the regulatory requirements of the State of New York. If the Constitution means anything to us here on FreeRepublic, then this is not negotiable.
