This would require a congressional waiver, of the type given to Sec State Marshall (who had previously been Sec War). A retired officer must be out of ranks for 10 years before he can be SecDef, but apparently this does not apply to any other cabinet positions, including VA head.
Somewhere, I read that they were going to try and get a waiver from Congress.
Don’t know if that’s true or not, or whether it’s feasible or not. But they wouldn’t be putting him forward without thinking that it is.
