In order for a threat to be prosecutable, it must be a "true threat". "True threats" exclude threats made in jest (e.g. saying "I'm going to kill you" when you find out you've been the butt of a practical joke) and crude, offensive political statements (see: Watts v. United States). Given that Banerian spent two weeks making political points about the alleged threat before reporting it to police, it seems Banerian recognized the alleged threat as a political statement and not a "true threat" against his safety.
