Well, he’s suing the defendant. The attorney tells the judge the defendant is dead and [probably] requests dismissal. Barring proof the attorney is actually lying to the court (of which his position and licensure denotes him as an officer and isn’t very productive for the parasite class).

The whole purpose of the suit is to record a judgement denoting the defendants allegations are false and collect damages. The purpose isn’t to determine defendants status as live or dead. The only reason his death is brought up by the attorney is to elicit a sympathy dismissal or to garner the sympathy benefit in negotiating a settlement. It’s irrelevant to the case.

The “family” is irrelevant. Mr. Doe's actions (obviously) happened before he died. His estate must pay the tab for his actions while alive.
