Agree.

The lower court (bad) ruling would stand. Wait a couple of weeks for the confirmation to take place and swearing in.

This actually can be used by Trump. Shows the importance of the Supreme court to be in place to ‘back the will of the people.’

Ginsberg is on her last leg. That’ll be a big fight when Trump replaces her with one of the 19 left from his list.

The Democrats will be fully aware of that and use it to block Gorsuch. It will motivate their base. They would have to go nuclear.

“Wait a couple of weeks for the confirmation to take place and swearing in.”

Grassley said USSC nominee will have to wait at least 6 weeks to be confirmed. It likely will be April/May!

I believe this is Trump’s purpose in making this situation occur. He wants us to fighting mad so we call our Senators over the SCOTUS nomination.

Do you really think Gorsuch can be sworn in within a couple weeks? I have read estimates of April 15.

I actually think Trump’s best move to replace Ginsburg would be to put up Merrick Garland. I think Obama named Garland for the simple reason he’s viewed as a more moderate judge - as Obama needed the Republicans in the Senate to approve him in his final year. From Obama’s perspective, trading Garland for Scalia was a great trade. For the same reason, trading Garland for Ginsburg would be worthy of much popcorn as the Dems twist themselves in knots to explain why Garland is now unacceptable — especially after squealing for the past year about getting a Senate hearing on him.

A couple of weeks? Try April, at best. A month, minimum, and that's if everything goes well.

You are assuming that justices Kennedy and Roberts would strike this down. I believe they both are corrupted. The Dems will pull out all stops to ensure they vote against Trump here, just like they did for Obamacare. This is everything to them. All the marbles. If they can’t move the third world to the US, they are done. (They are done if all the headchoppers come in anyway, but they’re to stupid to care.)
