Education is a RIGHT of the States not the over regulating, burdensome Federal Government, the DOE costs the States FAR more money then the supposed good it does. To my mind even the State should not be involved since most moneys for schools come from City and County property taxes, those states that have special additional State wide taxes for schools should be involved no more then it takes to disperse those money’s to the School Districts.

My guess is if it’s given back to Local Government that Tenure will be voted right out the door, Union Contracts be damned.

The federal government should be kicked out of the education business in every state that values freedom. To do that, they must refuse federal funds, because that money is always the bait used to entrap the states.

Exactly. The left will find some way to curtail our right to educate our children, no matter how well-crafted this legislation may appear.

It is true that any time you take federal money, you will eventually find yourself under the thumb of the next Barack Obama or George Bush. That’s what was so wrong about GW’s faith-based initiatives legislation.

Personally, I don’t think governments should be taxing religion or the efforts a parent takes to educate their children. Such a tax exemption is not a GIFT from the government.

It is no different than the Fed recognizing that the cost of entertainment for a business is a legitimate business expense that is not part of their net taxable income.

Private schools only because they keep the riffraff out. School choice is going to completely ruin private schools by letting them in.

You're correct in the sense that the Constitution does not even mention one word about education, but incorrect that education is a right of the States. It is a responsibility of parents to ensure the education of their children.

U.S. Constitution, Article [X] (Bill of Rights, Amendment 10 - Reserved Powers)

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Education is a "power" reserved to the people, who may choose to retain that power or delegate it to whomever they wish.

But - as you say - the states have the right, not the federal government and not the individuals.

The law may be, at best, pointless.
But as far as homeschoolers feeling threatened...aren’t they already?
I was homeschooled, and when/if I have children they will be homeschooled. The local school district had considerable power to make my life difficult, even to remove me from home altogether if they had a mind to. They had the state behind them. And HSLDA, though it does good when it does anything, doesn’t always do anything.
Child protection rackets are a threat. You need luck, connections, and/or money to get through the homeschooling years intact.
These problems aren’t going away, and piling on law won’t solve them.

The problem now is the government takes your school money then tells you which school to go to. I’ve paid some $40,000 in school taxes, but if I want to send the kids to another school I have to abandon that money and earn another $40,000.

Everyone else is paying that same $40k—even if they don’t have any kids making use of it.

So a start, at least, is reducing the role of government in education and eliminating the role of unions. Those are the two keys IMO.

IMO, this is a conundrum for vouchers. I would hope private schools would be non-union, non-tenure. use 'old' math and English teaching methods, not be sports-driven, have strict behavior and discipline rules and enforcement and teach only in English. Let there be specialized bi-lingual schools or tutoring services.

Repeat this to yourself a few times.

“Education is a RIGHT of the States “

Wrong. Education is the domain of the individual. Who is the government to tell me what I must learn?

What’s next, the State picking our profession like the Soviet Union did?? “You shall be a scientist. Now report to school.”

It's the government golden rule; “he who has the gold, makes the rules.”

If the local, state, or federal government provides a voucher or tax credit they are going to use that as leverage to tell the private school or home schoolers how they must operate to keep getting the $.
They do it with everything else, why are people shocked the scorpion stings this turtle too?
