This is what makes the 9th circus ruling so dangerous. By one interpretation it gives standing to ANYONE who wants to enter the country. That’s why the 9th has refused to stand down on suspending the original EO so they can set precedent. With a 4-4 SC almost anything could happen.
If you were arrested and then accused of being in the U.S. illegally, what manner of due process would you expect in order to regain your freedom?
That manner of due process must of necessity be exactly the same as that accorded to anyone accused of being in the U.S. illegally.
Once a person has been proven to be in the U.S. illegally, then it would be appropriate to mete out punishment designed to deter such illegal conduct.
