I think this administration’s mistake was issuing the second executive order before Gorsuch was approved for the SC putting the Court back to 5 to 4 because these cases are forum shopped in the liberal 9th circuit which has an 80 percent reversal rate when the SC is 5-4 conservative.The 9th circuit will uphold this district court’s ruling and we will have to wait until Gorsuch is on the bench to get it reversed. Hopefully that will be in April.
Exactly. It is up to the executive to enact the laws. If the court finds the law in question wrong, it can strike down the law, but it cannot bind the executive.

Agreed and the judge really has no authority. This is akin to a judge trying to block Trump from signing a spending bill passed by congress, or a judge trying to block a presidential pardon. Trump should just declare that he’s exercising his constitutional authority and that the ban will go forward as planned.

Committee hearings have not even started yet. The first hearing is scheduled for next week and everything is being slow walked. I think a confirmation vote is probably weeks away at best. The borders are wide open and between the Senate and the Judiciary, they are going to stay that way unless Trump decides to neutralize or remove jurisdiction from the courts.

I think their mistake was listening to the first judge. The Constitution gives the President the authority to enact the laws as HE sees fit. He is not beholden to the court’s interpretation, HE is the arbiter. All the court can do is strike down the law by finding it unConstitutional...which it isn’t.
I agree, but ultimately he will get his nominee and most likely his travel bans will be affirmed as he has great influence on how quickly cases are heard in any given court.
In the meantime (which could be years) while the cases meander about, the democrats seriously risk being tarred with the blood of innocent Americans dying because of an ISIS embed attack.
Time is not on their side politically on this issue.
If God forbid there is an attack and people die, Trump will blast a tweet to this effect, shaming the democrats and the courts, causing a major uproar, then hold a 8pm press conference one night and stab them right in the heart while millions watch.

As I understand it, this ban is executed on foreign soil. I have not heard a thing about this as a possible ace in the hole. Can he just not issue a visa - and can a judge order it?
But most assuredly, no matter what Trump's lawyers take to these judges, he will not be granted what the law says. So what is he going to do? Keep issuing a directive and keep getting smacked down? It makes him look impotent.

This has become an issue of the Courts exceeding their authority. You can addresses the vetting concurrently as all of this takes more than 90 days but on principal you have to fight this all the way to the Supreme Court after Gorsech is seated
