Court Criticizes Obama Admin for Illegal Spying On U.S. Citizens

Intelligence agencies violated the constitutional rights of American citizens through illegal surveillance during the Obama administration, recently declassified documents from the Foreign Intelligence Surveillance Court (FISC) show.

The secretive court also notes a change for the better under President Trump’s team.

The Foreign Intelligence Surveillance Act (FISA) authorizes two courts to provide judicial review for U.S. intelligence agencies when their activities require them to monitor people on U.S. soil. One is FISC, and the other is the court that hears appeals from FISC decisions, the U.S. Foreign Intelligence Surveillance Court of Review (FISCR). The benches of FISC are comprised of federal judges from regular federal trial courts throughout the nation, and three appellate judges from around the nation comprise the bench of FISCR.

The Office of the Director of National Intelligence (ODNI) recently declassified an April 26, 2017, ruling from FISC, detailing violations of Fourth Amendment rights during the final year of the Obama administration.

The problems dealt specifically with Section 702 of FISA. This provision of federal law, found at 50 U.S.C. § 1881a, contains “minimization” procedures for U.S. citizens whose information is scooped up by the intelligence community while those agencies are conducting FISA surveillance. These safeguards minimize the burden on civil rights caused by the intrusion of the federal government into citizens’ lives.

The Fourth Amendment commands:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

FROM ONE OF THE MANY EXPOSES---Seeking to retain his position as CIA director under Hillary, Brennan used phony foreign intel as a pretext for a multi-agency investigation into Trump.....that led the FBI to probe a computer server connected to Trump Tower and gave cover to Susan Rice's sifting operations....

Not only Brennan.... "Susan The Sifter" had a dog in this hunt......Hillary tapped her for Secy of State. One could conclude Comey also had his reasons .....to stay on as FBI director.

.......apparently there are records proving that Obama's CIA director, John Brennan, oversaw repeated spying on the phone calls of President Donald Trump and millions of other private American citizens. An audiotape just released by Federal Judge G. Murray Snow is part of a civil case........

Thankfully, Susan's so stupid, her public explanations of her intel activities set her up for a precipitous fall.

Taxpayers demand Rice answer questions....and they want answers now. Questions for Rice:

1. When did you request the unmasking, and from which agency?

2. Who in that agency actually did the unmasking? Please provide the written requests you submitted.

3. Once the names were unmasked, did you still believe there was a threat to national security from the named US persons?

4. If so, with whom did you share the information, and what actions were taken to protect America and American citizens?

5. If you did not, then you should not have shared the names with anyone else, so how did the names become known?

6. Why was any of the info detailed here deliberately withheld on the FISA application? (it's a felony to willfully withhold information when applying for a FISA).

<><> Why did Rice on PBS initially deny responsibility for the unmasking?

<><> Why was this threat not unveiled at the time or since? Why now?

Alarmingly, the supposed ‘threat’ identified by Rice was about to be inaugurated as President of the US. Shouldn’t Congress have been notified? Why did Rice keep it a secret? Maybe she planned to collude w/ the Clintons to sell the intel to a foreign country?

The NSA didn’t unmask the information initially, plus later investigations found NO collusion between Russia and Trump. Seems to be proof-positive that whatever suspicions Obama/Rice/Brennan may have had to justify the unmasking were absolutely wrong, or more likely non-existent.

Exactly. It's breathtaking to watch flagrant violations of law being “declassified” without a list of members of the Obama administration who are facing charges. It's like a big “Meh”.
