2. The ban is essentially approved. SCOTUS upheld it and agreed to hear arguments in September.
3. It will essentially be a moot argument 3 months into something that was already upheld.
4. Kennedy may very well leave the bench by then and the balance shifts in kur favor.
Quite possibly she will fall asleep during arguments. But she’ll be awake for voting. And her mind, such as it is, has been made up AGAINST Trump since last fall. THERE’s the rub. That’s why she needs to forced to recuse.
