The Feds because CNN made threats across State lines.
CNN really stepped in it this time. I am sure their CEO will be pleased. Haha!
This is how prosecution decisions seem to work in NY.
1. Does it harm Andrew Cuomo? If yes, don’t prosecute.
2. Does it help Andrew Cuomo? If yes, prosecute.
3. If neither, defer to next lower authority and repeat steps 1 and 2 with the next name on the list.

If they both were from NY, yes. If they aren’t it would be in Federal court since the blackmail would have occurred across state lines.
Here’s where we come to the realization that the NYS Attorney General is a hardcore Clintonite, and therefore nobody will be held to account for this crime.
