Actually, separation of powers says that they can. Recess appointments cannot be made if the Senate remains in session, and they just guaranteed they will remain in session through this parliamentary trick.

Obama tried declaring as the executive when the Senate was and was not in session and it had to go all the way to the Supreme Court to declare his illegal recess appointments were in valid and the President does not have the power to unilaterally declare when a coequal branch of government is or is not in session. That was one of scariest and most scandalous power grabs in history...now you essentially make the same argument? Are you serious?
